It is submitted that representative of the BKO was asked to supply documents to claim non operation of the brick kiln.
The industry has submitted an undertakings dated 25.05.2024 (copy attached) authenticated by CA which is reproduced as under:
Undertaking -1
I Darshna Devi w/o Babu Ram resident of Malout declare as under: -
1. That I was the proprietor of M/s Dashmesh Bricks Company, Village Tarmala, Tehsil Malout, District Muktsar.
2. That the lease period of my brick kiln was expired on 16/09/2022. That I have not continued the lease agreement after this.
3. That the above said kiln was transferred on my name on dated 01/01/2019 as Sh. Kashmir Singh S/o Sh. Ram Singh retired from the above said w.e.f 31/12/2018.
4. That I have not fired my brick kiln for the period commencing from 01/04/2015 to 16/09/2022.
5. That I have not used any coal & agro based bio mass for firing my brick kiln as I have not fired my brick kiln for the above said period.
6. That no Coal was purchased by me so I have not maintained any coal register.
7. That the above said kiln is now taken on lease by Smt. Shimla Devi w.e.f 17/09/2022. If the pollution board consent of my brick kiln will be transfer to Smt. Shimla Devi I will not have any objection.
Undertaking -2
I Shimla Devi W/o Jagdish Rai resident of Muktsar declare as under: -
1. That I am the proprietor of M/s Dashmesh Bricks company, Village Tarmala, Muktsar.
2. That the brick kiln has adopted induced draught technology and obtained completion certificate from CSIR-Central Building Research Institute, Roorkee on 29/11/2023.
3. That the brick kiln has not been operated on the coal & Agro Fuels both from the period 17.09.2022 till adoption of induced draught technology.
4. That I have not purchased any coal so I have not maintained any coal register for the above said period.
5. That the brick kiln is not using any fuel for the period 17/09/2022 to 31/12/2023 as the brick kiln was lying close and the kiln has not been operated till adoption of induced draught Zig Zag/technology after obtaining completion certificate from CSIR-Central Building Research Institute, Roorkee.
As per policy of the Board for calculation of EC for operation of kiln with conventional technology, the BKO is required to submit undertaking regarding operation of kiln with conventional technology and adoption to zig zag technology, which is required to be authenticated by CA. The BKO is also required coal register in this regard, which is also to be authenticated by CA.
As per undertakings above brick kiln has not been operated after Feb 2019 to November 2023 and the BKO has not maintained coal register as no coal has been purchased by them. The BKO has only submitted undertakings to claim the non operation of the kiln. From the undertakings authenticated by CA, BKO is remain non operational, as such no EC is required to be deposited by kiln.
