File Note: It is intimated that the project is a large-scale red category unit. The project proponent had earlier obtained Environment Clearance vide letter no. SEIAA/2716 dated 28.06.2016 for the construction of group housing project namely “Joynest MOH-1” with built-up area of 84344.673 sqm in the revenue estate of Village Chatt, Zirakpur by M/s Amazing Real Estate Pvt. Ltd. (Total no. of flats @ 1056 and shops @ 06). The total area of the project is 43164.716 sqm as per Environment Clearance granted vide letter no. SEIAA/2716 dated 28.06.2016. Thereafter, the project proponent had obtained Environmental Clearance vide letter no. SEIAA/634 dated 24.05.2018 for expansion of Group Housing Project namely “Joynest MOH-1” with built-up area of 115061 sqm in the revenue estate of Village Chhat, Zirakpur by M/s Amazing Real Estate Pvt. Ltd. (Total no. of flats @ 968 and shops @ 6). The total plotted area of the project is 43526 sqm (or 10.7552746 acres) as per Environment Clearance granted vide letter no. SEIAA/634 dated 24.05.2018. The project proponent was granted “Consent to Establish” (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2021/15622953 dated 09.08.2021 which is valid upto 26.03.2022 for the establishment of Group Housing Project for 968 flats and 4 shops having Built-up area 115061 sqm (total area of the project is 43164.716 sqm) with subject to suitable conditions mentioned therein. Thereafter, the promoter company was granted partial Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2021/16595737 dated 21.10.2021, valid upto 31.03.2022 for 361 flats with subject to suitable conditions mentioned therein. And the Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 was refused vide no. CTOW/Fresh/SAS/2022/16153000 dated 31.03.2022 as the project proponent is not complying with the provisions of Water Act, 1974. Earlier, the project proponent was given personal hearing before the worthy Chairman of the Board on 09.03.2022, wherein, it was decided as under: 1. The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 applied by the project proponent be refused. 2. The project proponent shall operate and maintain the STP regularly and efficiently so as to achieve the effluent standards. 3. The project proponent shall not discharge treated/untreated wastewater outside its premises. 4. The project proponent shall re-apply for grant of consent to operate with adequate proposal for scientific disposal of treated effluent. 5. Environmental compensation from the period 21.9.2021 to 28.2.2022 is imposed. In compliance of the decision no. 5 of the personal hearing the Board vide order no. 199 dated 16.06.2023 had imposed Environmental Compensation of Rs. 38,64,000/- for the activities carried out by the promoter company which have caused environmental damage for the period of 21.09.2021 to 28.02.2022. The project proponent was given personal hearing before the worthy Chairman of the Board on 09.03.2022, wherein, it was decided as under: 1) The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 applied by the project proponent be refused. 2) The project proponent shall operate and maintain the STP regularly and efficiently so as to achieve the effluent standards. 3) The project proponent shall not discharge treated/untreated wastewater outside its premises. 4) The project proponent shall re-apply for grant of consent to operate with adequate proposal for scientific disposal of treated effluent. 5) Environmental compensation from the period 21.9.2021 to 28.2.2022 is imposed. Thereafter, the project site was visited by Er. Taniya, AEE (O/s) of this office on 18.12.2023 and contacted Sh. Ratan Singh, Asst. Manager (9875919274) and it was observed as under: - 1. The project comprises of total 13 towers i.e. 1000 flats out of which the construction work of 5 towers i.e. 520 flats is fully completed. Whereas, Construction work for 8 towers is under progress. 2. The project proponent has provided occupancy in 397 flats currently. 3. The pp has installed 1 no. borewell for fresh water supply and water meter provided was lying dis-functional and no record was being maintained for the same. 4. The project proponent has provided an STP of capacity 650 KLD based on MBBR technology, which was in operation at time of visit. Water meter has been provided at O/L of STP and reading was noted to be 6698.9 Kl. 5. As per the record maintained by the project proponent it was observed that about 40-50 KLD of wastewater is being treated in the STP, which is verry less as compared to the occupancy of 400 flats. However, a sample of the same was collected and sent to HO lab for further analysis. 6. The treated wastewater is being used for horticulture remaining is being discharged onto land for plantation as per Karnal Technology provided in 2 acres, but no separate water meter has been provided to record the treated effluent being used in the green area. 7. The project proponent is not using treated wastewater for flushing purposes. Although project proponent has already provided pumps and mechanism for the same. The project proponent has also provided water meter on the flushing pipeline. 8. The project proponent has not provided mechanical composter and solid waste is disposed off to 3rd party vendor. 9. The project proponent has provided 4 DG sets of capacity- 62 KVA (for sales office) with canopy and inadequate stack height, 62 KVA (for project tower construction) with canopy and inadequate stack height, 500 KVA and 380 KVA for building with canopy and adequate stack height. Now, the project proponent has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 for development of 500 flats along with requisite documents and fee. As per record file of the project the previous consent fee is adequate upto 29.12.2022 against the project cost is Rs. 40 crores. Now, the project proponent has deposited (Total Rs. 6,17,000/-) Rs. 2,16,000/- vide R. No. 384962588 dated 13.04.2023, Rs. 2,33,000/- vide R. No. 976103350 dated 27.04.2023 & Rs. 1,68,000/- vide R. No. 201505165 dated 23.04.2024 under Water Act, 1974 and (Total Rs. 6,00,000/-) Rs. 4,32,000/- vide R. No. 718231120 dated 13.04.2023 & Rs. 1,68,000/- vide R. No. 932367172 dated 23.04.2024 under Air Act, 1981, against the project cost is Rs. 55.12 crores. The consent fee deposited by the project proponent is adequate upto 31.03.2027 under both acts after adjusting penalty/late fee and NOC regularization fee. The project proponent has also submitted the request letter for reviewing/re-calling the environmental compensation, which is attached. The site of the project was visited by officer of this office on 25.05.2024 and it was observed as under: - 1. The site of the project is located At Village Chatt, Zirakpur, Derabassi, SAS Nagar, Mohali. 2. The project comprises of 13-Towers, out of which 08 towers are ready i.e. about 576 flats. As per representative about 400 families are residing in the project. 3. The project proponent is in the process of installing mechanical composter of capacity of wet waste. The same is yet to be commissioned even after occupancy of 400 flats.. 4. The STP was in operation during visit & effluent sample were collected. The water meter reading at the outlet was noted to be 76593 KL. As per ground water record the daily abstraction is about 210 KLD. The ground water reading was noted to be 25015 KL. As per record about 170 KLD of effluent is treated daily in the STP. No separate record regarding reuse of treated effluent in green area, dual flushing, plantation is being maintained. 5. The project proponent has not provided ultra-filtration & treated water is not being used for flushing purposes, currently by the project. 6. The sample of effluent was collected from outlet of STP, which was turbid in appearance and didn’t appear suitable for reuse in flushing. 7. Also, the STP has not been provided as per SBR Technology as proposed during time of obtaining environment clearance for the project. 8. The plantation area of about 2.5 acre is about 500 m away from the project and temporary pipeline has been provided. However, the same has not been developed as per Karnal Technology and currently is inadequate to handle the discharge from the project. 9. A drain/nala is also passing close to the plantation area and it is apprehended that the project may be discharging its effluent into the choe at odd hours. 10. The project proponent has not submitted adequacy certificate of the 650 KLD Stp. Even the MLSS/ Bacterial growth in the aeration tanks was observed to be poor. No sludge was observed near the sludge handling area/filter press. 11. The project proponent has failed to submit EC of Rs 38,64,000/- till date. 12. Further, the project proponent has not submitted environmental protection fund of Rs. 10.0 lacs to the Board as required as per EC granted to it. 13. The project proponent has allowed occupancy in the project without obtaining prior consent to operate under Water Act, 1974 from the Board. In view of the above, it is recommended that the consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused due to above said violations please and punitive action may be initiated for recovery of environmental compensation from the project proponent.
