File Note: It is submitted that the subject cited industry is a medium scale red category unit. The industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/LDH1/2024/22122844 dated 15/01/2024 and under the Air Act, 1981 vide no. CTOA/Varied/LDH1/2024/24562572 dated 15/01/2024 both valid upto 31/03/2028 for the manufacturing of Dyed Acrylic Fiber/Yarn @ 1050 Kgs/day, Dyed Polyester Fabric @ 8325 Kgs/day and Laminated/Coated Fabric @ 17000 Meter/day. Now, the industry has applied ‘consent to establish'/ (NOC expansion) for addition of dyeing of polyester fabric @ 3425 Kg/day and finishing of fabrics @ 20 TPD by installation of new Dyeing machines of capacity 250 Kg (2 no.), 100 Kg (1 no.), 50 Kg (1 no.), 25 Kg (1 no.), 10 Kg (1 no.), Stenter (1 no.), replacement of existing boiler of capacity 2 TPH with 4 TPH, 600 U Thermopack with 2500 U Thermopack and addition of Steam Generator @ 1.5 TPH, etc. along-with requisite documents through OCMMS. The industry has earlier deposited Rs. 36500/- vide UTR No. N129243029228421 dated 08.05.2024, against the project cost of Rs. 2290.10 lacs, which is adequate for one year as per Board's Office Order dated 29/10/2018. Accordingly, the site was visited by the undersigned on 17/05/2024 and observed as under: 1. The industry is engaged in dyeing of fabric and has installed soft flow machines (500 x 1, 250 x 3, 120 x 1, 100 kg x 1, 60 kg x 2, 50 x 1 and 25 kg x 1). 2. The industry has installed one boiler of 2 TPH capacity (wood fired), which is equipped with HRU followed by dust collector as APCD. 3. Record regarding extraction of ground water and effluent sent to CETP has been maintained. 4. The industry has now proposed addition of dyeing of polyester fabric @ 3425 Kg/day and finishing of fabrics @ 20 TPD by installation of new Dyeing machines of capacity 250 Kg (2 no.), 100 Kg (1 no.), 50 Kg (1 no.), 25 Kg (1 no.), 10 Kg (1 no.), Stenter (1 no.), replacement of existing boiler of capacity 2 TPH with 4 TPH, 600 U Thermopack with 2500 U Thermopack and addition of Steam Generator @ 1.5 TPH, etc. 5. The industry has proposed to increase its trade effluent from 360 KLD to 488 KLD, which will be discharged into CETP line. 6. The industry has connected its trade effluent to CETP 40 MLD. 7. There was only single outlet of the industry, which was connected to CETP sewer. 8. Detail of existing and proposed production calculated vis a vis machinery installed is attached as Annexure-A. 9. As per the record maintained by the industry, the industry is discharging its effluent @ 330 KLD to CETP on an average. 10. The industry has CETP shares of 500 KLD. 11. The industry has installed 1 no. DG set of capacity 275 KVA. It has now proposed to install 2 no. DG set of capacity 500 KVA each with canopies and adequate stack heights. In the subject cited case, the industry has mentioned ground water extraction @ 643.5 KLD. The industry has obtained permission for ground water extraction from PWRDA vide no. PWRDA/I/11/2023/L2/226 dated 29.11.2023 for 14700 KL/Month. Site Suitability The industry has submitted transfer letters from PSIEC for plot no. C-125 vide letter no. 5075 dated 10/05/2022 and plot no. C-126 vide letter no. 5070 dated 10/05/2022. There are no specific sitting guidelines for such type of industries. However, the subject cited industry is located in Industrial zone as per Master Plan (2010-2031) of Ludhiana. Applicability of press note 17: The press note 17 (1984 series was withdrawn by Ministry of Commerce and Industry vide letter no. 2(41)/2018-IL dated 11/09/2019. Applicability of Factories Act, 1948: As per policy of the Board, it is clearly mentioned that the Punjab Pollution Control Board will decide the applications for consent to establish (NOC) of all industries to be set up in designated/ approved areas such as Industrial Area/ Industrial Estate / Industrial Focal Point/ Approved Industrial Park / Industrial Zone of the Master Plan. However, the Site Clearance u/s 41 (A) of the Factories Act, 1948 will not be necessary for grant of consent to establish/ operate/ authorization by the Board. It is submitted that the subject cited industry is located in Industrial zone as per Master Plan (2010-2031) of Ludhiana. Therefore, there is no requirement of Site Clearance u/s 41 (A) of the Factories Act, 1948. In view of the above, may if approved, it is recommended that ‘consent to establish'/ (NOC Expansion) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year with suitable conditions as per the Board.
