It is submitted that the project proponent has applied for obtaining fresh consent to establish (NOC) from pollution angle under green category under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for development of Commercial Shops and offices (Commercial Plot- 34 Plots) @ 34 alongwith requisite documents.
The project proponent has deposited Rs. 8900/- vide R. no. 873029969 dated 20.05.2024 as NOC fee. The fee deposited by the project proponent is adequate for one year against the total cost of the project Rs. 395 lacs.
The project proponent has submitted feasibility report regarding installation of STP of capacity 40 KLD. As per feasibility report, the total water requirement @ 39.6 KLD. The wastewater generation @ 31.68 KLD, out of which @ 30.8 KLD treated effluent reused for flushing/dual plumbing purposes and rest 0.88 KLD for spraying purposes in parking area within the premises after treated in STP.
The project proponent has submitted layout plan approved by Competent Authority. The project proponent has submitted retirement-cum-partnership deed executed between:
1. Sh. Vijay Kapoor S/o Sh. Rajinder Pal Kapoor R/o 1069, Top Floor, Sector-21B, Chandigarh (hereinafter party of the First Part).
2. Sh. Vikas Kapoor S/o Sh. Rajinder Pal Kapoor R/o 2131, Top Floor, Sector 38-C, Chandigarh (hereinafter party of the Second Part)
3. Sh. Parkash Thakur S/o Sh. lnderThakur R/o Flat no. 654, PSB Society, Sector 49-A, Chandigarh (hereinafter party of the Third Part)
4. Sh. Yugbir Chand Manchanda Slo Sh. Megh Raj R/o H.Ns. 18, First Floor, Sector 28-A, Chandigarh (hereinafter party of the Fourth Part)
5. Sh. Rohan Kapoor S/o Sh. Vijay Kapoor R/o 1069, Top Floor, $ector 21-8, Chandigarh (hereinafter party of the Fifth Part)

The proposed site of the project proponent was visited by the undersigned on 24.05.2024. During the visit, it was observed as under:
1. The project proponent has proposed to construct 34 commercial plots.
2. The project proponent has demarcated its site with flag pools.
3. No construction activity has been started at site.
4. As per notified master plan of Kharar, the site is located in the residential zone.
5. As per the boundary limits of the site shown by the representative of the promoter company during the visit, there is no operational approved existing MAH industry within a radius of 250 m from the boundary of the proposed site of the project. There is no operational approved existing air polluting industry falls within a radius of 100 m from the boundary of the project.
In view of the above, may if approved it is recommended that consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year subject to suitable conditions and following additional conditions that:
1. The project proponent shall install STP of capacity 40 KLD alongwith ultra-filtration/ UV system for utilization of treated wastewater for flushing purposes.
2. The project proponent shall provide dual plumbing for utilization of treated wastewater for flushing purposes.
3. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
4. The project proponent shall provide occupancy in the project in consonance with the disposal arrangement of treated wastewater available with it.
5. The project proponent shall provide occupancy only after obtaining consent to operate from the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
6. The promoter company shall submit the complete drawing and design of the evaporator and its components at the time of obtaining consent to operate.
7. The Board shall not be responsible for any financial loses, in case the project proponent fails to provide adequate disposal arrangements of treated wastewater.
8. The project proponent shall install anti smog gun to control dust emission during construction activities.
9. The project proponent shall provide mechanical composter of adequate capacity for the treatment of wet biodegradable waste.
10. The promoter shall develop its project strictly in accordance with the layout / building plans approved by the Competent Authority.
11. If the project proponent violates any of the above 10 conditions, legal action under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated against the project proponent without affording any opportunity.
12. The promoter shall lay down pucca distribution network / pipe grid from the STPs to the various green lawns / stretches / dual plumbing system for flushing purposes / for construction activities and shall not allow it to stagnate anywhere inside or outside the project.
13. The promoter shall irrigate the green belt / area to be developed within the project area with the treated wastewater only and no fresh water will be used for this purpose as well as for construction activities within the project.
14. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity.
15. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
16. The promoter company shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
17. The promoter company shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
18. The promoter company shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing on-site facility to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
19. The promoter company shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
20. The promoter company shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
21. The promoter company shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form.
22. The promoter company shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
23. The promoter company shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
24. The promoter company shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
25. The promoter company shall provide mask to every worker working on the construction site and involved in loading / unloading and carries of construction material and construction debris.
26. The promoter company shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
27. This NOC is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/ project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
