Subject: Proceedings of the personal hearing given by the Chief Environmental Engineer (B) of the Board for refusal of renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 to M/s Shiva Speciality Yarn Ltd., Bathinda Barnala Road, Tapa Mandi, Tapa, Barnala on 02/05/2024.

Environmental Engineer, Zonal Office-II, Patiala brought that the industry is a large scale orange category spinning unit and was granted renewal of consents to operate of the Board under Water Act, 1974 vide no. CTOW/Renewal/BAR/2022/18194686 dated 04/01/2023 valid upto 31/03/2024, with suitable conditions and special condition that :-
1. The industry will operate & maintain its STPs regularly and efficiently, so as to achieve the prescribed effluent standards on regular basis.
2. The industry shall comply with the guidelines of the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water.
3. The industry shall not add any additional air polluting source without prior written permission of the Board.
The industry has applied for the renewal of consent to operate under Water Act, 1974 for the same production i.e. manufacturing of Cotton Yarn/ Synthetic Yarn @ 23.0 MTD by using Polyster/ Acryllic Fibre @ 30 MTD as raw material. To verify the facts, the industry was visited by AEE of Regional Office, Sangrur on 12/03/2024 and it was observed as under :-
1. The industry was in operation and engaged in the Process of spinning of cotton / polyster / acrylic fibre for manufacturing of cotton / synthetic yarn.
2. The industry has installed two Spinning sheds, however only one shed was in operation during visit.
3. The industry generates only domestic effluent and for the treatment of the same it has installed the STP and same was found not in operation. However, the condition of STP indicates that it is not being operated on regular basis, algae was also seen in the tube settler. Due to non-operation of STP sampling could not be carried out.
4. The industry also not submitted any analysis report of its effluent sampling.
5. The weir at tube settler was also found rusted.
6. The wild grass was also seen in the plantation area and required to maintain it properly.
The industry is not complying with the conditions of the Consent to Operate granted to it under the Water (Prevention & Control of Pollution) Act, 1974. Thus, violating the provisions of the said Act and causing water pollution intentionally & deliberately in the vicinity.
Accordingly, show cause notice for refusal of renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with an opportunity of personal hearing before the Chief Environmental Engineer on 02/05/2024.
The representatives of the industry attended the personal hearing and submitted a written reply, which was taken on record. They further stated that at the time of the visit of the officer of the Board on 12/03/2024, the STP was under maintenance. Now, the STP is being operated regularly. The wild grass has already been cleaned from plantation area. The weir of the tube settler has been repaired and they requested to drop the notice.
After hearing the officers of the Board and representative of the industry, Chief Environmental Engineer (B) Patiala decided that :
1. The renewal of Consent to operate applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 be refused.
2. The industry shall re-apply for renewal of Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 within 15 days.
3. The industry shall submit bank guarantee amounting to Rs. 2.0 lakh an assurance for regular operations of the STP as well as compliance of the Environmental Laws at Regional Office, Sangrur within 7 days.
4. Environmental Engineer, Regional Office, Sangrur verify the contentions of the industry, collect effluent sample from the outlet of STP and process the consent application to be submitted by it under the Water (Prevention & Control of Pollution) Act, 1974 on merits, immediately after 15 days.
If approved, the proceedings may be conveyed to the industry as well as Regional Office for ensuring compliance, please.
