Subject: Application for obtaining fresh consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 - M/s Hargobind Sahib Rice & General Mills, Village Sounti, Amloh, Distt Fatehgarh Sahib.
Reference: Rice Sheller's online application ID 25664029 and 25664031 dated 21/05/2024.
It is submitted that the rice sheller was granted consent to establish under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, vide no. CTE/Exp/FGS/2023/23206204 dated 16/08/2023 valid up to 15/08/2024 for Processing of Paddy @ 4.5 TPH (With Drier) to produce Rice @ 3 TPH.
Now, the rice sheller has applied for fresh consent to operate under the provision of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along-with requisite documents through OCMMS. The rice sheller has deposited Rs. 84000/- vide no. POD022084225 dated 17/05/2024 as water consent fee, Rs. 2100/- vide UTR no. POD022083991 dated 17/05/2024 as penalty under water act and Rs. 84000/- vide no. POD022084088 dated 17/05/2024 as air consent fee, Rs. 2100/- vide UTR no. POD022084158 as penalty fee against the fixed assets of Rs. 171.71 Lakh as on 28/02/2024 as per CA Certificate dated 16/03/2024. The consent fee is adequate up to 31/03/2034 as per Board's Office Order dated 29/10/2018.
To verify the contents, the industry was visited by the AEE of this office on 27/05/2024 During the visit, it was observed as under:
1. The rice sheller was in operation during the visit.
2. The rice sheller has for Processing of Paddy @ 4.5 TPH (With Drier) to produce Rice @ 3 TPH.
3. The rice sheller has installed the mechanical drier and has provided cyclone separator as APCD with the same. The rice sheller has also submit the completion certificate.
4. The rice sheller has submitted the latest analysis report for the stack emission of the Sheller Section from M/s Environ Tech Laboratories dated 18/01/2024 and the result i.e. particulate matter is 226 mg/Nm3 which is within limits as per prescribed by the Board.
5. The industry has not installed any D.G. set.
6. No water used in the process therefore no trade effluent is generated. Domestic effluent generated was being discharged onto land for plantation after passing through septic tank.
7. The rice sheller has submit the land use pattern from DTP certificate no. 865 dated 11/08/2023.
8. The rice sheller has planted the plants along the boundary wall within its premises.
9. The rice sheller has submitted the copy of certificate of principal approval form Invest Punjab.
10. The rice sheller has provided septic tank for treatment of its domestic effluent generated from toilet/bathrooms.
Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:
"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 0.5 KLD. Considering 150 working days per year, ground water extraction will be 6.25 KL/month, which is less than 300 KL/month. The rice sheller has no need for permission for abstraction of ground water from PWRDA.
Keeping above in view, if approved, that the fresh consent to operate under the provision of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted up to 30/09/2033 for Processing of Paddy @ 4.5 TPH (With Drier) to produce Rice @ 3 TPH with usual conditions (auto generated) along-with the following special conditions as under:
1. The rice sheller shall submit the building plan approved from the Director of Factories/Competent Person and submit the same in the Regional Office, Fatehgarh Sahib.
2. The industry shall submit air emission analysis report on priority basis in the upcoming paddy processing season.
3. The rice sheller will comply with CGWA Guidelines.
4. The rice sheller shall discharge its domestic effluent onto land for plantation after treatment in septic tank.
5. The rice sheller shall ensure that at any time the emissions do not exceed the emission standards laid down by the Board from time to time.
6. The adequacy and efficiency of the air pollution control device will be the entire responsibility of the rice sheller.
7. The rice sheller shall not discharge any fugitive emissions. All gases shall be emitted through a stack of suitable height, as per the norms fixed by the Board from time to time.
8. The rice sheller will comply with the following code of practice notified by the Govt.
i) All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories.
ii) The rice sheller should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the rice sheller.
iii) All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 metres above the roof of the building.
iv) The management and handling of rice husk in the rice shelling units should be done as under: -
a. All the rice shelling units shall provide paved / brick roads / cement concrete roads/ metalled roads inside their premises for movement of vehicles, so as to prevent the generation of dust.
b. The rice sheller shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10' high or 3.5' higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35' on each side of the rice husk discharge pipe.
c. The rice sheller shall provide a layer of wind screen of mild steel or some other similar material of at least 5' height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of airborne particulate from storage, handling and loading / unloading areas of rice husk.
d. The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15'' which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3' length.
e. Wherever the height of rice husk is 3' or more, the rice sheller shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70 gm/m2 weight having 40-45 hole/inch2 to prevent wind blowing of stored husk.
f. During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds.
9. The emission standards given in the order dated 13/9/2006 will remain operative for Rice Sheller’s and Saila Plants. These emission standards are reproduced as under: -
g. Emission Standards for Rice Sheller’s & Saila Plants in the State of Punjab will be applicable as under: -
a. Emission standards 750* SPM (mg/Nm3) b) Inside the building TLV of air** SPM (mg/Nm3) NOTE: * The existing units not meeting with the prescribed siting guidelines will meet with stack emission standards of SPM 500 mg/Nm3. ** To be controlled by the Director of Factories.
10. The rice sheller shall continue to comply with the new code of practice notified by Govt. Notification no.10/48/2004-STE (4)/932 dated. 15/10/2013 at all the times.
11. The rice sheller shall abide by the fresh directions (if any) issued by the Hon'ble Punjab & Haryana High Court/ Govt./ Board for compliance of code of practice of rice sheller.
12. The rice sheller shall not cause any nuisance/traffic hazard in vicinity of the area.
13. The rice sheller shall shift its location to designated area as per directions issued by the State Govt./ Board from time to time and time frame stipulated in Master Plan for rice sheller located in MC limits.
14. The rice sheller shall upgrade/ replace the APCD as per latest notification issued by the Ministry of Environment & Climate Change, New Delhi to achieve the revised emissions stands as amended time to time.
15. The rice sheller shall submit the stack emissions analysis report from Board's lab during the upcoming season.
16. The rice sheller shall comply with provisions of Punjab Regional & Town Planning & Development Act, 1995(Amended from time to time).
