Samita, Environmental Engineer, Zonal Office-2, Ludhiana On behalf of the industry Sh. Sanjeev Jaggi, Proprietor The Environmental Engineer, Zonal Office-2, Ludhiana brought out that the industry was granted 'Consent to Operate' under Water Act, 1974 vide no. CTOW/Renewal/LDH1/2022/20130198 dated 17.11.2022 valid upto 31.03.2023. The industry is a scattered dyeing unit and was issued notice to issue directions u/s 33-A of the Water Act, 1974 with hearing before Chairman of the Board on 06.07.2023, wherein it was decided as under:- 1. The industry shall immediately dismantle and remove all outlets and shall stop discharging its trade effluent into sewer. 2. The industry shall not operate its outlet for discharge of trade effluent into sewer without obtaining prior permission /consent of the Board. 3. The Authorities of Municipal Corporation Ludhiana shall immediately disconnect the sewer connection available to the industry for disposal of its trade effluent. 4. The Environmental Engineer, Regional office-1 Ludhiana shall ensure the compliance of above directions and shall submit its report, immediately. The industry was visited by officer of the Board on 26.07.2023 it was found that the industry is still in operation, in violation to the decisions of the decisions of hearing held before the Chairman of the Board. The regular complaints were being received regarding colored effluent in sewer lines. The industry was again visited by officers of the Board on 14.10.2023 in the evening, to verify the complaint regarding overflow of colored effluent from the sewer manhole in the Janakpuri area. Various violations were observed and the industry was still carrying out the wet process, in violation to the directions issued by the Competent Authority of the Board. Directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 were confirmed against the industry for disconnection of electric connection. In compliance to the directions, PSPCL authorities have issued TDCO vide no. 7/104 dated 23.11.2023 regarding disconnection of electric connection. The industry applied for 'Consent to Operate' under Water Act, 1974 with same disposal i.e. into MC sewer which was returned with directions to industry to apply for washing & finishing process only, as the unit is not carry out dyeing process. The industry has now applied for consent to operate under Water Act, 1974 for Washing of Acrylic Yarn @ 1500 Kg/day and Finished Shawls @ 300 nos./day, and the process is primarily orange category i.e. washing. The industry was visited by officer of the Board on 02.04.2024 and it was observed that the industry was not in operation due to unavailability of electric connection. The industry has already installed ETP for treatment of effluent, which is capable of treating the proposed effluent of washing of acrylic fabric. The unit is covered under scattered category. The unit has proposed to carry out washing only in dyeing machinery which is not a convincing proposal. In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 with hearing before Chairman of the Board on 20.05.2024. Sh. Sanjeev Jaggi, Proprietor of the industry attended the hearing and submitted a written reply which was taken on record. He submitted that the industry has applied for consent to operate under Water Act, 1974 for washing of fabric in yarn cabinet machines. The ETP already installed for treatment of effluent. He further requested for grant of consent for washing of fabric and finishing of fabric alongwith restoration of electric connection. After hearing the industry, officers of the Board and considering material facts on record, after deliberations, it was observed that technically, it is not feasible to wash fabric in cabinet dyeing machines which are meant for dyeing of acrylic yarn, the Chairman of the Board decided as under: 1. The request of the industry for using dyeing machinery for washing only is not accepted. 2. The consent to operate applied by industry under the Water (Prevention & Control of Pollution) Act, 1974 be refused due to above said reasons.
