File Note: The industry is a small scale green category unit and was running without ETP and without consents of the Board. Accordingly report was sent to higher authority and the unit was given personal hearing before the Chief Environmental Engineer of the Board on 20.12.2023, wherein it was decided as under:- 1. The Environmental Engineer, Regional office-1 Ludhiana shall verify the contention of the industry regarding operation of washing process and shall seal the machinery of washing process, if found in operational condition and send report within 03 days. 2. The industry shall not discharge any trade effluent and discharge only domestic effluent into sewer. 3. The industry shall submit permissibility certificate from Municipal Corporation, Ludhiana, within one month. 4. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with permissibility certificate, within one month. In compliance of the decisions of the personal hearing the washing machine was sealed by the visiting officer on 19.01.2024 and report regarding installation of ETP was sent to the Competent Authority through E-office. Another opportunity of personal hearing was given on 28.03.2024 and no one attended the hearing. During the hearing the competent authority decided to give another opportunity of personal hearing to the industry. The notice of hearing is yet to be issued. Now, the industry has applied for fresh consent to Operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Ladies cardigan @ 650 Number/day by using of Yarn @ 300kgs/day, Silicon @ 1.6 kgs/day and nonanoic @ 0.4 kgs/day. The industry has filled online application form, uploaded latest CA certificate, manufacturing process, Site Plan/Location Plan, MSME certificate, DTP certificate bearing no. 868 dated 09.04.2024, copy of installation of machinery(boiler) proof as date of commissioning. The industry has deposited Rs. 46200/- vide no. N137243042599397 dated 16.05.2024 under Water Act, 1974, Rs. 4200/- vide no. N137243042576554 dated 16.05.2024 as NOC regularization fee. Rs. 46200/- vide no. N137243042597707 dated 16.05.2024 under Air Act, 1981. As per the CA certificate the applicable fee is Rs. 4200 per annum, the industry has deposited consent fee for 10 years. The adequacy of fee deposited is upto 31.12.2026 after deducting penalty fee The industry was visited by this office on 27.05.2024 and observed as under:- 1. The industry was in operation during the visit, however the wet process was not in operation due to off season and sealing of machinery. 2. In compliance to decision no. 1 of the personal hearing, the industry has submitted Govt. notification dated 06.10.2023 regarding regularization of units in non-designated area. As per the approved master plan Ludhiana, the area where the unit is situated falls in Mix land use area. Further as per Govt. of Punjab notification dated 06.10.2023, relief has been given to existing industry operating in residential zone and has been allowed to operate for further 3 years i.e. upto 10.09.2026 subject to fulfillment of PPCB norms. The copy of the said notification attached here with. Further, the industry has submitted DTP certificate bearing no. 868 dated 09.04.2024 mentioning that the area is industrial mix. In industrial mix green category units are permissible. The industry falls under the green category, as the unit is a washing unit with discharge less than 2 KLD. As per categorization 3067- Hosiery /Garment manufacturing with washing only (without bleaching and dying) with discharge less than 2 KLD and is connected to Public sewer comes under green category 3. All the machinery installed by the industry is non-polluting in nature, except two no. washing machines of capacity 50 KG and 75 KG 4. The industry has provided physiochemical ETP of design capacity 4 KLD for the treatment of trade effluent, and the effluent after treatment is discharged into sewer. The ETP comprises of collection tank-chemical dozing-floculator-settler-prefilteration tank-MGF and ACF. 5. The industry has provided EMF at the outlet of ETP and also on the source of fresh water. 6. The domestic effluent is also discharged into sewer. 7. The industry has installed one baby boiler of capacity 500 kg with adequate stack height, the industry has also installed nos. D.G. sets of capacity 80 KVA with canopy & adequate stack height. In view of the above, it is recommended that, application may be forwarded to the Competent Authority of the Board for dropping the action against the industry under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with orders of de-sealing of washing machines as the industry has comply with decisions of the personal hearing. After dropping of action/approval of the competent authority, 'Consent to Operate' under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry up to 31.12.2026 with suitable conditions as per policy of the Board please.
