File Note: It is intimated that the establishment is a small scale orange category unit, engaged in process of M.S Casting and C.I Casting by operating 1 no. of induction furnace and was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide letter no. CTOA/Renewal/SGR/2018/8103715 dated 30/08/2018, expired on 30.06.2019 and consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide letter no. CTOW/Renewal/SGR/2018/8103758 dated 30/08/2018, expired on 30/09/2023, for the production of M.S Casting and C.I Casting @ 4.5 TPD by using C.I Scrap and M.S Scrap @ 5 T/day as raw material by operating 1 no. of induction furnace, under orange category with certain conditions mentioned therein. Last year, the industry was visited by the then AEE of this office on 12.07.2023 and was found violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 framed under Environment (Protection) Act, 1986. Accordingly, the industry was issued show cause notice alongwith personal hearing vide Board's letter no. 3035 dated 24.08.2023. On dated 05.09.2023, Sh. Harbhajan Singh, representative of the industry attended the personal hearing and submitted the written reply, which was taken on record. He further informed that the industry has installed only one induction furnace with two cruses. The industry has provided bag filter house equipped with stack of recommended height. In the drawing given by PSCST, no spark arrestor has been proposed. The industry has already made request to TSDF, Nimbuan to lift the APCD dust from its premises. The industry has started to maintain the record of the same. The industry shall apply for consents of the Board under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 alongwith authorization under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 within one month. After hearing the officer of the Board, representative of the industry Senior Environmental Engineer, Zonal Office-II, Patiala decided that : 1. The industry shall apply for consents under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and authorization under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 within 15 days. 2. Environmental Engineer, Regional Office, Sangrur shall visit the industry to verify the submission made by it during hearing and process the applications to be applied by it on merits. He shall also submit his comments on the requirement of spark arrestor. Now, the industy has applied for obtaining varied consents of the Board under the Water Act, 1974 and the Air Act, 1981. The industry has submitted following documents alongwith application: - 1. Affidavit From Nidhan Singh (Proprietor of M/s D.F Industries), which is reproduced in agenda note. 2. Affidavit From Harbhajan Singh (Proprietor of M/s Darshan Foundary Works), which is reproduced in agenda note. 3. Water & Air Compliance report 4. Completion Certificate obtained from PSCST, Chandigarh bearing no. 659 dated 23.01.2024 w.r.t. installation of APCD with induction furnace of capacity 500 kg/heat. 5. Lease deed dated 22.02.2024 of premises of M/s Darshan Foundary Works, which includes land & building alongwith electric connection 6. CA certificate mentioning the value of gross fixed assets of the industry i.e. M/s D.F Industry alongwith lease value of land & building of its adjoining industry i.e. M/s Darshan Foundary Works. From the submissions made by the industry, it is clear that the industry i.e. M/s D.F Industry has purchased plant & machinery and take land & building on lease of its adjoining industry i.e. M/s Darshan Foundary Works. In this way, M/s D.F Industry has been included the fixed assets of M/s Darshan Foundary Works in its books. However, the applicant has proposed to operate plant & machinery of electric induction @ 500 Kg per heat and keeping electric induction @ 300 Kg per heat as standby. The industry has electric connection of capacity 359 KW for operation of its induction. The electric connection can run only 01 of the above inductions at one time and the small induction of capacity 300 Kg per heat will be kept as standby only. As the adjoining industry i.e. M/s Darshan Foundary Works is commissioning its unit separately as per the record of the Board, it is necessary to go through the record of the same, which is reproduced as under: - M/s Darshan Foundary Works is a small scale orange category unit, engaged in process of M.S Casting and was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide letter no. CTOA/Fresh/SGR/2018/8232683 dated 30/08/2018, expired on 30.06.2019 and consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide letter no. CTOW/Fresh/SGR/2018/8232779 dated 30/08/2018, expired on 30/09/2023, for the production of MS Casting with CNC Lathe Machine @ 1.6 T/day by using MS Scrap @ 1.6 T/day as raw material, by operating 2 no. of induction furnaces, along with certain conditions mentioned therein. Lastly, the industry was visited by the then AEE of this office on 12.07.2023 and was found violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 framed under Environment (Protection) Act, 1986. To verify the facts on ground, both the industries i.e. M/s D.F Industry as well as M/s Darshan Foundary Works was visited by the AEE of this office on 27.05.2024 and it was observed as under: - 1. Now, the both industries have been merged and became M/s D.F Industries. The industry was in operation alongwith its 02 no. induction furnaces having capacity 300 Kg/heat and 500 Kg/heat. One of the induction furnace of capacity 500 kg/heat was found in operation and other induction furnace was not in operation during visit. 2. The industry has provided common hood with both the furnaces followed by bag filter as APCD along with adequate stack height. 3. The industry has installed 01 no. silent DG set of capacity 136 KVA equipped with canopy and stack of adequate height. 4. No trade effluent is being generated by the industry. The domestic effluent i.e. hand-washing water is used for wetting the mould making sand. The industry is re-circulating the entire cooling water. 5. However, the applicant has proposed to operate plant & machinery of electric induction @ 500 Kg per heat and keeping electric induction @ 300 Kg per heat as standby. The industry has electric connection of capacity 359 KW for operation of its induction. The electric connection can run only 01 of the above inductions at one time and the small induction of capacity 300 Kg per heat will be kept as standby only. 6. The industry is complying with the conditions imposed in the consents granted to it under both the Acts. It is also necessary to go through the value of fixed assets of M/s. D.F Industries and M/s Darshan Foundary Works mentioned in CA certificates submitted earlier and the present one submitted by the M/s. It is, therefore, recommended that varied consents to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30/09/2025 subject to suitable conditions and following additional condition: 1. The industry shall not generate and discharge any kind of trade effluent without obtaining prior written permission of the Board. 2. The industry shall re-circulate entire cooling water. 3. The industry shall obtain fresh authorization under the HOWM Rules, 2016 within one month. 4. The industry shall get the compliance report of the office order dated 15/06/2018 and Standard operating procedure (SOPs) for induction furnaces, which is reproduced as under:- A. The industry shall get its Air Pollution Control Device (APCD) alongwith its collection system evaluated from Punjab State Council for Science & Technology, Chandigarh regarding efficacy, alongwith the side hood design, within 15 days. B. After evaluation, APCD and its collection system including hood shall be upgraded / replaced by the industry as per the advice of Punjab State Council for Science & Technology by 31/07/2018. C. The industry shall appoint dedicated staff for operation / maintenance of APCD / collection system, within one month. The industry shall implement the Standards Operating Procedures (SOPs) prepared by Punjab State Council for Science & Technology for APCD in toto, so as to achieve the prescribed standards on a regular basis
