It is intimated that earlier, the industry was a orange category small scale unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/SGR/2022/19272590 dated 17/07/2022 valid upto 30/09/2027 and under the Air Act, 1981 vide no. CTOA/Varied/SGR/2022/19272396 dated 17/07/2022 valid upto 30/09/2027 for manufacturing of Sorted Raw Rice with Dryer @ 2.0 TPH by using Paddy @ 3.0 TPH as raw material under the name of Shri Dhar, (Partner).
The industry has submitted an affidavit attested by Notary, wherein it has been mentioned that the rice sheller is commissioned in khasra no. 138//18 (8-0), 19 (6-18), 20/1 (2-14) measuring total land 17 kanal 12 marle at Village Hambalwal, Jakhepal. Now, the industry wants to establish PVC unit and will dismantle rice sheller within 03 months upto 31.08.2024. The industry has also submitted that it will dismantle the rice sheller machinery and surrender the consents of the Board.
Now, the industry has applied for obtaining NOC/consent to establish of the Board for establishing a PVC unit under small scale green category i.e. for manufacturing Plastic Marble Sheets and PVC Panels @ 5.0 T/day by using Resin @ 1.5 T/day, Calcium Carbonate @ 3.0 T/day & Chemicals @ 1.0 T/day as raw material under the name of Vishal Jindal, Partner.
The industry has deposited NOC fee of Rs. 14,900/- (14,400/- NOC fee + Rs. 500/- application fee) vide no. 823711987 dated 27.05.2024 against the proposed cost of project amounting Rs. 1471.59 lakhs (proposed cost of plant and machinery Rs. 485.0 lakhs), which is valid for one year.
The industry has submitted old DTP certificate along with new Land use classification certificate issued from DTP, Sangrur vide memo no. 480 DTP(S)/RS-1 dated 10.04.2024, which is stating that the subject site is located on the Jakhepal-Mojowal road at a distance of about 1.71 km from Phirni of village Jakhepal, on the left hand side of Khasra No. 138//18 (8-0), 19 (6-18), 20/1 (2-14) of revenue estate village Hambalbas, the total land area is 17 kanals and 12 marles. In which rice sheller is commissioned. A CLU had already been issued for the said area vide this office's letter No. 909 DTP(S), dated 24.05.2017 for M/s Pooja Rice Industry, Village Hambalbas (Jakhepal) and the building plan of this rice shellar had been Approved by Director of Factory vide date 03.07.2017. Now, the industry increases the land area of 4 kanals 10 marles in the adjacent place of the site. After expansion in land, the total land area of the site becomes 22 kanal 2 marles and now the industry proposed to install PVC unit in this site. No Municipal Council/ Nagar Panchayat boundary and Phirni/ lal lakir of any village falls within 100 meters radius of the site. The site falls within the Notified Local Planning Area Sunam, the master plan of which is yet to be prepared. Director Nagar and Village Planning Department, Punjab vide letter no. 2180-2283 STP(PB)/SP.432 (Gen) dated 14.06.2023, the PVC unit is permissible on the condition that "The applicant shall be liable to abide by the provisions of master plan and shall also be bound to follow the provisions of Section 79 along with other provisions of PRTPD Act 1995, in case the site falls in non confirming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the department."
The industry has submitted retirement-cum-partnership deed executed on 29.07.2020, as per which Smt. Pooja Rani w/o Sh. Rakesh Kumar was got retired from the firm and now 03 no. partners are running the firm namely Sh. Vishal Jindal s.o Sh. Prem Chand, Shri Dhar s/o Sh. Sham Lal and Sh. Dharminder Pal s/o Sh. Karam Chand.
To verify the facts, the site of the industry has been visited by the officer of this office on 28.05.2024 and it was found as under:-
1. The site of the industry is located at Village Hambalwal, Jakhepal. There is no MC/NP limit, village lal lakir/phirni, 15 pucca houses within the radius of 100 mtr of this project. Also, there is no HT wire passes through the site of the industry.
2. No construction work has been stated at site. The rice sheller is yet to be dismantled.
3. The industry has proposed to manufacture Plastic Marble Sheets and PVC Panels by using Resin, Calcium Carbonate & Chemicals as raw material.
4. As per the project proposal, there will no generation of any trade effluent. However, the industry has proposed to generate domestic effluent @ 1.6 KLD, which will be discharged onto land for plantation after passing through septic tank.
5. The industry has proposed to install a D.G set of capacity 500 KVA equipped with canopy and stack of adequate height.
6. The rice sheller has closed its operation and complete its milling. Moreover, the industry has submitted affidavit wherein it has been mentioned that the rice sheller is commissioned in khasra no. 138//18 (8-0), 19 (6-18), 20/1 (2-14) measuring total land 17 kanal 12 marle at Village Hambalwal, Jakhepal. Now, the industry wants to establish PVC unit and will dismantle rice sheller within 03 months upto 31.08.2024. The industry has also submitted that it will dismantle the rice sheller machinery and surrender the consents of the Board.
Hence, the site is suitable for the establishment of said project as per the siting guidelines for such projects.
In view of the above, it is recommended that NOC/Establish be granted to the industry for one year for manufacturing of Plastic Marble Sheets and PVC Panels @ 5.0 T/day by using Resin @ 1.5 T/day, Calcium Carbonate @ 3.0 T/day & Chemicals 1.0 T/day as raw material with suitable conditions and special conditions that:-
1. The project project will obtain permission from PWRDA from abstraction of ground water.
2. The project proponent shall not start construction activity at site without prior intimation to the Board alongwith surrender of consents granted by the Board.
3. The Board shall not be responsible for liability, if any, of other concerned departments for converting purpose of land use from rice sheller to commercial establishment.
4. The project proponent shall obtain necessary permission from other departments, if need be.
