it is submitted that 03 appeals filed by the SPV i.e. Imposition of EC of amount 01 crore to the SPV vide minutes of meeting dated 08.10.2021. 2. Imposition of EC of amount 77.625 to the SPV vide Board's no. 335 dated 4.10.2022 3. Against the decision of the Board to obtain Performance Bank Guarantee of Rs. 2.4 Crores from the SPV have been dismissed by the Appellate Authority vide orders dated 20.05.2024. Copy of the orders are attached herewith for kind perusal please. It is pertinent to mention here that EC amount of 1 crore had already been deposited by the SPV and EC amount of Rs. 77.625 lacs had also been recovered from performance bank guarantee of Rs. 2.4 crore earlier submitted by the SPV but the SPV has not submitted performance bank guarantee of remaining amount after deduction of the EC i.e. (2,40,00000 - 77,62,500 = 1,62,37,500) till date and now appeal filed by the SPV against this BG has already been dismissed by the Appellate Authority.
As proposed by RO, it is recommended that Show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be issued to the SPV, BKTKA with an opportunity of personal hearing before the Hon'ble Chairman of the Board, please. |
