It is submitted that the subject cited rice sheller unit was granted consent to establish (NOC) under the Water Act, 1974 & the Air Act, 1981 for establishment of unit to produce raw rice with dryer @ 5 TPH & Sorted Rice @ 5 TPH, vide no. CTE/Fresh/FZR/2023/22889282 dated 21.07.2023, valid upto 20.07.2024 with suitable conditions.
Now, the industry has applied for obtaining fresh consent to operate for operation of the unit under the Water Act, 1974 & the Air Act, 1981 for same capacity through OCMMS along with requisite documents. The details of the case as under:
• The industry has submitted latest CA certificate, stating value of fixed assets of Rs. 245.41 lakhs (including plant & machinery of Rs. 146.75 lakhs) as on 31.03.2024.
• The industry has deposited consent fee of Rs. 54,000/- vide UTR / Ref. No. 411284434 dated 24.05.2024 under the Water Act, 1974 & Rs. 54,000/- vide UTR / Ref. No. 647606307 dated 24.05.2024 under the Air Act, 1981, which is adequate upto 30.09.2028 as per Board's order dated 29.10.2018.
• The industry has submitted undertaking regarding completion of installation work of cyclone separator as APCD installed with dryer section and shelling section, separately.
The industry was visited by the undersigned on 27.05.2024 and it was observed as under:
• The industry was in operation during visit.
• The industry has not installed cyclone as APCD with shelling section and emissions were being discharged directly into atmosphere.
• The industry has installed cyclone as APCD with dryer section. However, adequate stack height has not been provided with the same.
• The industry has not provided brick wall of adequate height around husk discharge / storage area and further mesh wire of 5' height has not been provided above the said wall.
• The industry has provided brick paving at movement area of vehicles, within its premises.
• The industry has provided septic tank for treatment of domestic effluent. The industry has not made provision to discharge onto land for plantation.
• The industry has not provided adequate along its boundary wall.
• The industry is not complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
Keeping in view of above, it is recommended as under:
1. Consent to operate applied by the industry under the Water Act, 1974 & the Air Act, 1981 may be refused please.
2. Show cause notice may be issued to the industry for violating the provisions of Water Act, 1974 and Air Act, 1981.
