It is submitted that as per letter issued by DTP Ludhiana vide no 3195 dated 26.10.2021, the site of the industry is located in industrial mixed zone. In the present case, the unit has commissioned since 05.05.2021 as per proof of date of commissioning of the unit, as per copy of electricity bill submitted by it.
The District Town Planner, Ludhiana has clarified vide its letter no 2073 dated 14.08.2023 stating that:-
ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਆਪ ਵੱਲੋਂ ਪ੍ਰਾਪਤ ਹਵਾਲੇ ਅਧੀਨ ਪੱਤਰ ਦੇ ਸਬੰਧ ਵਿੱਚ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ Amendment in Unified Zoning Regulations of Master Plans ਅਨੁਸਾਰ ਜ਼ੋ ਕਿ ਮੁੱਖ ਨਗਰ ਯੋਜਨਾਕਾਰ, ਪੰਜਾਬ, ਚੰਡੀਗੜ੍ਹ ਜੀ ਵੱਲੋਂ endst no. 5780-581 (PB)/SP-135 dated 24.09.2021 ਰਾਹੀਂ ਲਾਗੂ ਕੀਤੀਆਂ ਗਈਆਂ ਸਨ, ਜਿਸ ਦੇ ਨੁਕਤਾ ਨੰ: ਸੀ ਵਿੱਚ ਦਰਜ “Industries in Industrial Mixed Zone within the Municipal Limits” ਮਾਸਟਰ ਪਲੈਨ, ਲੁਧਿਆਣਾ ਤੇ ਵੀ ਲਾਗੂ ਹੁੰਦਾਂ ਹਨ। ਇੱਥੇ ਇਹ ਵੀ ਦੱਸਣਾ ਯੋਗ ਹੋਵੇਗਾ ਕਿ 15 ਸਾਲ ਤੱਕ ਚੱਲਣ ਵਾਲੀਆਂ ਉਦਯੋਗਿਕ ਇਕਾਈਆਂ ਦੀ ਸ਼ਰਤ ਕੇਵਲ ਮਾਸਟਰ ਪਲੈਨ ਦੇ ਨਾਲ ਕੰਫਰਮਿੰਗ ਲੈਂਡ ਯੂਜ਼ ਜ਼ੋਨ ਤੇ ਲਾਗੂ ਸੀ। ਇਹ ਆਪ ਜੀ ਸੂਚਨਾ ਅਤੇ ਅਗਲੀ ਲੋੜੀਂਦੀ ਕਾਰਵਾਈ ਹਿੱਤ ਪੇਸ਼ ਹੈ ।
Thereafter, in view of above clarification given by the DTP Ludhiana, the Board vide its letter no. 610-12 dated 31.08.2023 decided that the industries located in industrial mixed zone, which has now become conformity zone as per above notification be granted further consents as per policy of the Board.
It is recommended that consent to operate under Water Act, 1974 may be granted to the industry upto 30.06.2028 with suitable conditions and special condition that the industry shall be bound to comply and shift to designated industrial area if any office order/ direction is issued by State Govt. regarding amendment in Master Plan of Ludhiana in future.
