It is submitted that the industry is a small-scale green category unit. The industry has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of tractor & automobile transmission gear & shaft @ 5000 Numbers/Day by using CNC Blanks Turned @ 5000 Numbers/Day as raw material along with requisite documents and fee.
The industry has deposited Rs. 80,300/- vide R. No. 821541276 dated 23.05.2024 (Rs. 54,600/- under the Water Act, 1974, Rs. 16,800/- as Penalty/late fee, Rs. 8,400/- as NOC Regularization fee & Rs. 500/- as application form fee and Rs. 71,400/- vide R. No. 697458379 dated 23.05.2024 (Rs. 54,600/- under the Air Act, 1981 & Rs. 16,800/- as Penalty/late fee, against the fixed assets of Rs. 2.90 crores on 26.04.2024. The consent fee deposited by the industry is adequate upto 31.12.2028 under both the Acts.
The industry has submitted sale deed made on dated 07.04.2015 between Sh. Sukhdev Kumar and M/s Raja Gears Pvt. Ltd. for land 8 Bigha 0 Biswa at Village Behara, Tehsil Derabassi, Distt. SAS Nagar and another sale deed made on dated 02.02.2015 between Sh. Sukhdev Kumar and M/s Raja Gears Pvt. Ltd. for land 5 Bigha 16 Biswa at Village Behra, Tehsil Derabassi, Distt. SAS Nagar.
The industry has submitted the copy of electricity bill as proof of commissioning and as per which the date of commissioning of the unit is 04.08.2022.
The industry has submitted the copy of change of land use for industrial purposes vide no. PBIP/STP/2015/255 dated 28.07.2015 digitally signed by Gurpreet Singh (Senior Town Planner) for land measuring 2.85 acres. The details of land are as under: -

The industry was visited by AEE of this office on 29.05.2024 and it was observed as under:
1) The industry was in operation during the visit and engaged in manufacturing of tractor & automobile transmission gear & shaft. The industry is only carrying out machining.
2) The manufacturing process of the industry is as under: -
CNC Blank Turned—Hobbing—Shaping—Shaving—Rounding—Grinding—Dispatch.
3) There is no source of trade effluent.
4) The industry is generating domestic effluent which is discharged onto land for plantation after passing through septic tank.
5) The industry has installed one no. D.G set of capacity 400 KVA, which is equipped with canopy and adequate stack height.
6) The industry has submitted site plan prepared by Er. Rishi Garg Competent Person from Director of Factories, Punjab.
In the view of above, it is recommended that the 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry up to 31.12.2028, with subject to suitable conditions and additional conditions that: -
1. The industry shall not start any new process within its unit which may change its category from Green to Orange/Red, without the prior written permission of the Board.
2. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
3. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
4. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within one month.
5. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
6. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
7. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
