The industry was issued show cause notice for refusal of consent to establish (NOC) applied by it under the Water Act, 1974 and the Air Act, 1981 due to the reasons that the industry in his written submission mentioned that it will use mixed plastic granules, which make the process covered permissible limits prescribed by the Board / State Government under orange category. Also, the industry had failed to submit complete compliance report of general siting guidelines ie. distance report of nearest ULB and approved residential area from the proposed site of the industry......................
Now, the industry has submitted its reply to the SCN in the shape of undertaking, which is reproduced as under:-
“ਮੈਂ ਚਿਮਨ ਰਾਏ ਪੁੱਤਰ ਰਾਏ ਸਿੰਘ ਵਾਸੀ ਪਿੰਡ ਨਿਹਾਲ ਖੇੜਾ ਤਹਿਸੀਲ ਅਬੋਹਰ ਜਿਲਾ ਫਾਜ਼ਿਲਕਾ ਦਾ ਰਹਿਣ ਵਾਲਾ ਹਾਂ । ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਘੋਸ਼ਣਾ ਕਰਦਾਂ ਹਾਂ ਕਿ –
1. ਮੇਰੇ ਵੱਲੋਂ ਅਬੋਹਰ ਫਾਜ਼ਿਲਕਾ ਰੋਡ ਤੇ ਪੈਂਦੇ ਪਿੰਡ ਬਜਿਦਪੁਰ ਕੱਟਿਆਂ ਵਾਲੀ ਦੇ ਮੁਰੱਬਾ ਨੰ 155 ਕਿੱਲਾ ਨੰ 17/1/1, 16/1/3/2 ਵਿੱਚ ਸ੍ਰੀ ਕਰਨੀ ਇੰਡਸਟਰੀ ਨਾ ਦੀ ਪਲਾਸਟਿਕ ਪਾਈਪ ਬਣਾਉਣ ਵਾਲੀ ਫੈਕਟਰੀ ਲਗਾਈ ਜਾਣੀ ਹੈ।
2. ਇਹ ਕੀ ਇਹ ਫੈਕਟਰੀ Municipal counsil limit, ਲਾਲ ਲਕੀਰ, ਫਿਰਨੀ ਜਾ ਰਿਹਾਈਸ਼ੀ ਏਰੀਆ ਤੋਂ 100 ਮੀਟਰ ਤੋਂ ਵੱਧ ਦੂਰੀ ਤੇ ਹੈ ।
3. ਇਹ ਕੀ ਇਸ ਫੈਕਟਰੀ ਦੇ 100 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ 15 ਜਾਂ ਇਸ ਤੋਂ ਵੱਧ ਪੱਕੇ ਮਕਾਨ ਨਹੀਂ ਹਨ ।
4. ਇਹ ਕੀ ਜਿਹੜੀਆਂ ਪਾਈਪਾਂ ਫੈਕਟਰੀ ਵਿੱਚ ਬਣਾਈਆਂ ਜਾਣਗੀਆਂ ਉਹ ਕੇਵਲ ਵਰਜਿਨ ਪਲਾਸਟਿਕ ਤੋਂ ਬਣਾਈਆ ਜਾਣਗੀਆਂ । “ ................................
The proposed site of the unit was visited by undersigned (AEE) on 29.05.2024 and it was observed as under:-
1) The site is vacant plot located at Abohar-Fazilka Road. The site is surrounded by agricultural fields. No Municipal limit and residential has been observed within 100 meters of the proposed site.
2) The representative of the industry has informed that the industry will provide septic tank for treatment of domestic effluent onto land for plantation.
...................................In view of the reports of DTP, Fazilka and report of general siting guidelines issued by the Sub Divisional Magistrate, Fazilka, the site is suitable for establishment of plastic pipe manufacturing unit under green category...........
Keeping in view of the above, it is therefore recommended that consent to establish (NOC) may be granted to the industry for establishment of plastic pipe manufacturing unit in an area of 5 kanal 6 marlas bearing khasra no. 155//16/1/3/2(1-15) 17/1/1(3-11) in the revenue estate of Bazidpur Kattianwali, Tehsil & District Fazilka under green category, subject to the suitable conditions alongwith the following specific conditions :-
1) The industry shall not use recycled plastic granules / dana.
2) The industry shall not obtain permissions from the other departments.
3) The industry shall not change its manufacturing process / capacity without obtaining prior permission of the Board.
