It is intimated that earlier, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 which was valid upto 11.11.2023 along with temporarily restoration of electric connection upto 11.11.2023 vide Zonal Office Letter no. 4478 dated 13.09.2023. Thereafter, the industry has applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The stone crusher was visited by the officer of this office on 14.11.2023 and observed that the stone crusher is not complying with the code of practice prescribed for stone crusher. Accordingly, the show cause notice for violation under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 issued vide this office letter no. 1997 dated 15.11.2023. It is further intimated that letter written to the PSPCL Authority to comply with decisions of the Competent Authority to disconnect the electric connection vide this office letter no. 2122 dated 05.12.2023 and 2386 dated 27.12.2023. In compliance of the show cause notice, the industry had requested to give some time to remove the violation observed during the visit and also requested return the application applied under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thereafter, the industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Accordingly, the industry was again visited by officers of this office on 11.12.2023 and observed that the stone crusher is not complying with the code of practice prescribed for the stone crushers. Accordingly, the show cause notice for refusal of consent to operate under to the industry along with personal hearing before the Addl. Senior Environmental Engineer on 22.12.2023 vide this office letter no. 2328 dated 18.12.2023, wherein it was decided that: 1. The Asstt. Environmental Engineer shall visit the stone crusher within 07 days to check the code of practice and submit report accordingly. 2. The consent applied under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 by the stone crusher be decided on merits. Thereafter, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 applied by the industry were refused vide no. CTOW/Renewal/HSP/2023/24417965 and CTOA/Renewal/HSP/2023/24417960 dated 29.12.2023. Now, the industry has obtained autorenewal consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTO/Renewal/HSP/2024/24260362 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTO/Renewal/HSP/2024/24260352 dated 26.02.2024 valid upto 26.02.2025, respectively. The industry had requested to restore the electric connection for further period as the same has been disconnected by the PSPCL Authority. The industry was visited by the officer of this office on 03.04.2024 and during visit contacted Sh. Pawan Kumar, Munshi of the stone crusher and stone crusher was not in operation. The stone crusher has not properly covered the dust emitting points. The stone crusher has not properly provided conventional chutes at the end of conveyor belts. The stone crusher crusher has not got conducted any health survey of its worker not any record of the same was available. The stone crusher needs to plant more trees around the boundary. The stone crusher has not provided sprinklers at movement area of the vehicles. The stone crusher has provided re-circulation tank for the recirculation of washed water, but the stone crusher has provided underground pipeline laid leading to nearby choe for discharge of wastewater. The stone crusher has provided one no. DG set with canopy and adequate stack height. The stone crusher has installed 02 no. submersible pump for water extraction without water meter. During visit, the representative of the stone crusher informed that the electric connection disconnected by the PSPCL vide TDCO No., 3007509144 dated 19.02.2024. Accordingly, show cause notice for revocation of the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the stone crusher vide this office letter no. 867 dated 10.04.2024. Thereafter, the stone crusher has submit the reply of the show cause notice through email dated 23.04.2024 mentioning that the stone crusher is complying with code of practice prescribed for stone crusher and also requested to restore the electric connection of the stone crusher. Accordingly, to verify the contention of the stone crusher, the officer of this office was visited by the stone crusher on 25.04.2024 and during visit contacted Sh. Pawan Kumar, Munshi of the stone crusher and stone crusher was not in operation. The stone crusher has covered the dust emitting points. The stone crusher has provided conventional chutes at the end of conveyor belts. The stone crusher has provided plant around the boundary. The stone crusher has provided sprinklers at movement area of the vehicles. The stone crusher has provided re-circulation tank for the recirculation of washed water and removed the underground pipeline laid leading to nearby choe for discharge of wastewater. The stone crusher has provided one no. DG set with canopy and adequate stack height. The stone crusher has installed 02 no. submersible pump for water extraction with water meter
The application of restoration of electric connection was sent to Zonal Office, Jalandhar. The competent authority has decided that the stone crusher needs to apply fresh consent to operates under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Accordingly, the autorenewal consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were revoked vide letter No. 1257 dated 27.05.2024.
Thereafter, the stone crusher has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Keeping in view of above, if approved, it is recommended that :
1) Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for six months with the condition that the stone crusher shall comply with the complete code of practice before commissioning of the operation of the stone crusher.
2) The electric connection of the stone crusher may be restored for six months.
