File Note: It is intimated that the unit is a small scale green category layered poultry farm having birds capacity of 80,000 birds. Earlier, the poultry farm had applied for NOC/ consent to establish of the Board vide application no 8216036 dated 06/08/2018 which was refused at Regional Office level due to the reason that the project proponent had failed to comply with the siting guidelines prescribed by the Central Pollution Control Board (CPCB) vide its letter no. B-4032/PCI-SSI/Poultry/2015/13165 dated 20/10/2015. The reasons are as under: 1. The site of the poultry farm was located in the revenue estate of village Nangal on a link road connecting Village Karamgarh with Village Sherpur. 2. The project proponent had completed construction of boundary wall of the poultry farm and had constructed 01 no. poultry shed without obtaining NOC / Consent to operate from the Board. 3. The boundaries of poultry shed already constructed were located within 10 mtr distance from farm boundary. Thereafter, the poultry farm had again applied for NOC vide application no 9746156 dated 01/05/2019 which was returned at RO level due to incompletion of application. Then, the poultry farm had applied for consent to operate under the Water Act, 1974 vide application no 12033724 dated 13.01.2020 and consent to operate under the Air Act, 1981 vide application no 12033374 dated 13.01.2020 and both were also returned at RO level due to incompletion of applications. Thereafter, the poultry farm was visited by officer of this office on 07.02.2024 during visit to the area and it was observed as under:- 1. The poultry farm is located at village Nangal, Tehsil and District Barnala and was in operation. 2. The representative of the poultry farm has informed that the same was in operation since 2018. 3. The poultry farm is a layered poultry farm and has constructed 3 no. of single storey sheds and 1 Chick/grower shed. The poultry farm provided nipple system for drinking purpose of birds. 4. There is no residential zone/houses, zoo sanctuary in the radius of approx. 500 mtr from the site of the poultry farm. There is no any water body in the radius of approx. 200 mtr, there is no drinking water source and state highway in the radius of approx. 100 mtr from the site of the poultry farm. 5. The poultry farm has provided the three deep burial pits for the disposal of dead birds with concrete covers. 6. The birds littering is used to make manure/composite inside the premises. Little Smell was observed only inside the premises close to the composite making area. 7. The poultry farm has own feed mill of capacity 7 T/day without cyclone as APCD. 8. The domestic effluent generated from poultry farm was being discharged directly onto land for plantation inside the premises. 9. The farm has provided a holding tank inside the premises underground to collect the cooling water arising from the poultry shed. Due to above said violations, a separate E-note was processed vide no. 25392190 for sending the report to the Zonal Office-II, Patiala. In this note SEE, ZO-II, Patiala had directed to this office to deal the case at RO level vide note dated 16.04.2024 as Competency to decide the case lies with Environmental Engineer, RO. Therefore, the poultry farm was issued show cause notice with an opportunity to file reply within 10 days vide this office letter no. 2252 dated 03.05.2024. The poultry farm vide its letter dated 18.05.2024 had submitted the reply of show cause notice that the poultry farm has now installed cyclone as APCD in its feed mill. The poultry farm has also connected its discharge supply of domestic effluent with septic tanks. The poultry farm had also assured that it will maintain clean and safe environment within its premises and will take their environmental responsibilities seriously. The poultry farm has applied for consent to operate under the Water Act, 1974 and the Air Act, 1981 for the production of Eggs @ 72,000 Numbers/Day & Poultry Feed (For Self Consumption) @ 10 T/day by using Laying Birds @ 80,000 Numbers/Day & Maize, Soya, Mustard, Sun Flower, DOC, Bazra, Lime stone & GNE @ 10 T/day as raw material under green scale small category. The poultry farm has submitted electricity bill as the proof of date commissioning, wherein the date of connection is mentioned as 19.07.2018, hence, date of commissioning is consider as 19.07.2018. The poultry farm has deposited fee of Rs. 7000/- vide R. No. 64/4935 dated 02.05.2019 and Rs. 500/- vide R. No. 65/4935 dated 02.05.2019 through cheque, Rs. 32,900/- (Rs. 21,600/- as consent fee + Rs. 10,800/- as penalty fee + Rs. 500/- application fee) vide no. 708082800 dated 13.01.2020, Rs. 1,65,000/- vide no. 524499116 dated 26.05.2024 under the Water Act, 1974 and Rs. 32,400/- (Rs. 21,600/- as consent fee + Rs. 10,800/- as penalty fee) vide no. 960254158 dated 13.01.2020, Rs. 1,66,900/- (Rs. 1,65,000/- as consent fee + Rs. 1400/- NOC regularization fee + Rs. 500/- application fee) vide no. 631600658 dated 26.05.2024 under the Air Act, 1981. The total value of fixed assets is amounting Rs. 299.78 lakhs as per CA certificate dated 24.04.2024. Therefore, fee deposited by the poultry farm is adequate upto 31.12.2035 (after deducting the penalty fee and NOC fee). The poultry farm has submitted latest revenue report given by Tehsildar, Barnala vide dated 22.05.2024, which is stating as under:- 1. Distance of residential area from the site of poultry farm is more than 500 mtr. 2. There is no river, suya, kassi (water body) etc. in area of 200 mtr. 3. There is no drinking water storage in area of 500 mtr. 4. There is no water tanki in area of 100 mtr. 5. There is a rice mill namely M/s Balaji Rice Mill in front of poultry farm. 6. There is no National Highway in area of 200 mtr. 7. There is no State Highway in area of 100 mtr. 8. There is no pagdandi. Shed of the poultry farm is 10 mtr away from main road. To verify the facts, the site of the poultry was visited by the officer of this office on 15.05.2024 and it was observed as under:- 1. The poultry farm located at Village Nangal, Karamgarh to Sherpur Road, Tehsil and District Barnala and was in operation. 2. The poultry farm is a layered poultry farm and has constructed 3 no. of single story sheds and 1 Chick/grower shed having total capacity of 80,000 birds. The poultry farm provided nipple system for drinking purpose of birds. 3. During visit, no significant flies/odour was observed inside the poultry farm. There was on flies/odour outside the poultry farm. 4. There is no residential zone/houses, zoo sanctuary in the radius of approx. 500 mtr from the site of the poultry farm. There is no any water body in the radius of approx. 200 mtr, there is no drinking water source and national highway/ state highway in the radius of approx. 200 mtr from the site of the poultry farm. 5. The poultry farm has provided the three deep burial pits for the disposal of dead birds with concrete covers. 6. The birds littering is used to make manure/composite inside the premises. Same is being given to the farmers for using as manure. 7. The poultry farm has now provided cyclone as APCD with its feed mill. 8. The farm has provided a holding tank inside the premises underground to collect the cooling water arising from the poultry shed. 9. The domestic effluent generated from poultry farm was being discharged onto land for plantation through septic tank. 10. The poultry sheds now has been constructed more than 10 mtr from the road passing in front of the poultry farm. The distance of the road from the poultry sheds has been also mentioned in the revenue report i.e. Shed of the poultry farm is 10 mtr away from main road. The owner of the poultry farm in this regard had submitted that after the refusal of earlier NOC in 2018, it had reconstructed and shifted the sheds more than 10 mtr from the road, so as to meeting with the guidelines. The poultry farm has also constructed jalis/mesh of mild steel along its all boundary wall for proper ventilation and odour dispersion. Although, the poultry farm was constructed in 2018, it is now, complying with the SoPs/sitting guidelines issued by the CPCB in 2022. A copy of the compliance of SoPs is also enclosed herewith. In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 be granted to the poultry farm upto 31.12.2035 (upto adequacy of fee) with usual conditions and special condition that the poultry farm will comply with the Environmental Guidelines issued by the CPCB on regular basis.
