The report /recommendations of Regional Office be persued. Earlier the BKO was issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act 1981 for disconnection of electric supply vide letter no. 2079-90 dated 11/7/2022 due to utilization of un-authorized fuel by the BKO. Thereafter, the electric connection of was restored temporarily & Environmental Compensation of Rs. 50,000/- was imposed on it. The industry has already submitted the Environmental Compensation. During visit on 7/7/2023 the brick kiln was not in operation due to rainy season. No unauthorized fuel was seen stored at site. The BKO has stored only small quantity of coal as fuel at site. The industry is complying with the code of practice.
During latest visit on 31.5.2024, no unauthorized fuel was found at the BKO and the BKO was complying with the code of practice. The Competency to decide the case is with Regional office and it has principally approved the consent to operate.
In view of the above, it is recommended that:-
1. Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act 1981 may be issued to BKO for restoration of electric supply for permanently.
2. The Regional Office may be allowed to grant consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 for 06-months i.e. upto 31/01/2024 with usual conditions and special condition that:
A). The brick kiln shall not use any illegal fuel at site. The brick kiln shall use 20% paddy straw pellets based fuel with coal in future.
B). The brick kiln will provide more plants along boundary wall.
