File Note: It is intimated that the industry has applied for obtaining “Consent to Establish” (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Crushing of river bed material @ 4000 CFT/day & Screening cum Washing of River Bed Material @ 4000 CFT/day by using River bed material @ 4000 CFT/day as raw material alongwith requisite documents and NOC fee. The industry has deposited NOC fee of Rs. 4,100/- vide R. No. 207214539 dated 23.05.2024, against the proposed cost of project of Rs. 69.05 lacs. The NOC fee deposited by the industry is adequate for one year. The industry has submitted the partnership deed executed on dated 26.04.2024 between Sh. Yoan Kumar and Sh. Parvinder Kumar for the business under the name and style of M/s Neel Kanth Stone Crusher and Screening Plant. The proposed site was visited by AEE of this office on 30.05.2024 and it was observed as under: - 1. The proposed site is located in Village Hamayupur, Tehsil Derabassi, Distt. SAS Nagar. 2. The project proponent has not carried out any construction at site. 3. No plant and machinery installed at site. 4. The industry has submitted land classification certificate issued by DTP vide letter No. 64 dated 16.01.2024, as per which the site falls in industrial zone as per Master Plan Lalru. 5. The industry has submitted the distance certificate from SDM Derabassi vide no. 503/ਸ dated 16.06.2020 as per which: (copy attached) Sr. No Guidelines prescribed for stone crusher unit Relevant distances as certified by SDM 1. 5 Km from local body limit/MC The proposed site falls outside 15 Km from local body limits. 2. 2 km from city limits of A-Class Town The proposed site is at distance of 15 km from city 3. 1.5 km from city limits of B-Class Town The proposed site is at distance of 15 km from city 4. 500 m from National Highway/State Highway/ Scheduled Road The proposed site falls outside 600 m from National Highway/State Highway/ Scheduled Road limits. 5. 500 m from Phirni/LalLakir/Wild Life Sanctuary / Zoo/ Residential Area The proposed site falls outside 1 km from Phirni/LalLakir. 6. 300 m from Educational Institute/ Historical Religious Places / Protected Monuments The proposed site falls outside 1 km from Educational Institute/ Historical Religious Places/ Protected Monument limits. As such, the industry is meeting with the siting guidelines prescribed for such units. 6. The industry has proposed to install septic tank for the treatment of wastewater generated and further discharge onto land for plantation. For process water from screening cum washing plant will be reuse the process water after treatment in the High Rate Thickener. 7. The stone crusher has submitted compliance of Environmental Guidelines for Stone Crusher circulated by CPCB in July, 2023 and the stone crusher will comply with the said guidelines. In view of the above facts, it is recommended that the “Consent to Establish” (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Crushing of river bed material @ 4000 CFT/day & Screening cum Washing of River Bed Material @ 4000 CFT/day by using River bed material @ 4000 CFT/day as raw material may be granted to the industry for one year with suitable conditions and special conditions that: - 1. The industry shall comply with the Environmental Guidelines for Stone Crusher circulated by CPCB in July, 2023 and shall accordingly provide cyclone/bag filter as APCD as prescribed in the said guidelines. 2. The industry shall submit a copy of the approved building plans from the approved architect of Director of Factories, Punjab before the commissioning of unit. 3. The industry shall provide thickner/centrifuge for recirculation of washing effluent. 4. The industry shall not operate its screening-cum-crushing unit without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 5. The industry shall comply with the code of practice framed by the Board for such type of unit. 6. The industry will not indulge itself into any kind of illegal mining activity & will procure its raw material from sources having authorization of the concerned Mining Department for mining purposes. 7. The unit shall maintain a stock register to justify the legitimate source of mining material, its availability, usage and sale etc. 8. The industry shall comply with the provisions of the Punjab Minor Mineral Concession Rules or any other rules framed there under the Mines and Mineral (Development & Regulation) Act, 1957. 9. The industry shall bound to comply with the bye laws of Master Plan of the area notified by the Deptt. of Town & Country Planning, Punjab. 10. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 11. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 12. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received. 13. The CTE/NOC is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 14. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
