It is intimated that earlier, the brick kiln was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 issued vide no. CTOA/Renewal/ASR/2016/4527279 dated 22/09/2016, which is valid upto 30/09/2025 for gravity dust settling chamber.
Now, the subject cited brick kiln has applied for varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent under Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Brick & Tiles @ 45,00,000 nos/year. The brick kiln has deposited Rs. 29,000/- vide UTR No. AXSK240600016081 dated 29.02.2024 as consent fee and Rs. 5800/- vide UTR No. AXSK240600016116 dated 29.02.2024 as Penalty fee under Air Act, 1981. The brick kiln has deposited Rs. 46,400/- vide UTR No. AXSK240600016228 dated 29.02.2024 as consent fee Water Act, 1974, to make fee adequate up to 30/09/2032 under both Acts against the fixed assets of the industry below 50 Lakhs. The brick kiln has also deposited Rs. 2900/- vide UTR No. AXSK240600016165 dated 29.02.2024 as NOC regularization fee and Rs. 500/- vide UTR No. AXSK240600016033 dated 29.02.2024 as application form fee.
The project proponent has submitted Compliance report of previous granted consent, CA Certificate regarding fixed assets, Partnership Deed comprising 03 partners i.e. Sh. Rajan Sethi, Sh. Navdeep Singh & Sh. Gaurav Gupta, Lease Deed which is valid up to 01/11/2034, Location Plan, Drawing of brick kiln issued by Central Building Research Institute, Roorkee and Feasibility Report issued by Central Building Research Institute, Roorkee.
The Brick Kiln has submitted the copy of Design adequacy cum Completion certificate issued by Central Building Research Institute, Roorkee vide dated 06/12/2023, mentioning that the subject cited brick kiln has constructed hi-draft brick kiln with zig-zag technology, rectangular in design as per CSIR-CBRI design. The Brick Kiln has also submitted the copy of dimensional drawing/plan & section of Kiln showing the length of Central Island of brick kiln less than 245 ft.
The brick kiln has also submitted that they have not operated their brick kiln from the period of Feb 2019 to Dec 2023 and has submitted the coal summary as proof for operation of brick kiln for above mentioned period, which is duly verified by M/s Ravinder K. Sharma & Co., Chartered Accountants.
The subject cited brick kiln was visited by AEE on 29/05/2024 and observed as under:-
1) The brick kiln was not in operation at the time of visit.
2) The brick kiln has been converted into Induced draft technology with zig- zag settings.
3) The passage around the vessel was stabilized with Brick Bats & Keri etc.
4) The approach road to the Brick Kiln is pre-mix carpeted.
5) The brick kiln has provided adequate stack fitted with induced draft fan.
6) No un-authorized fuel found stored in the premises of the brick kiln at the time of visit.
7) The BKO has planted trees along the boundary of the kiln. However, it was guided to plant more saplings in coming season.
Keeping in view of the above, if approved it is recommended that varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent to operate Water (Prevention & Control of Pollution) Act, 1974 may be granted to the brick kiln for a period up to 30.09.2032 with the conditions as under:-
1. The brick kiln shall use 20% paddy straw pallet by replacing coal as per office order issued by the Board.
2. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
3. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
4. The brick kiln will plant adequate trees around the boundary of the Brick Kiln.
