Sub:- Application for obtaining Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981- M/s Gurdaspur Brick Works, VPO-Pahre, Tehsil and District-Gurdaspur.
Earlier, the Brick Kiln was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide online reference no. CTOW/Fresh/GRP/2020/12448057 and CTOA/Fresh/GRP/2020/12400930 dated 08/04/2022, which were valid upto 30/09/2024 under Orange Category. Now, the subject cited BKO has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS mode along with requisite documents.
The industry has deposited Rs. 9000/- vide UTR No. CBINH24150392980 dated 29/05/2024 and Rs. 9500/- vide UTR No. CBINH24150392968 dated 29/05/2024 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, which are adequate upto 30/09/2029 including Rs. 500/- as Form downloading fee against total gross value of fixed assets worth Rs. 21,03,605.00/- as on 31/03/2024 as per CA certificate submitted by the BKO.
The BKO has already submitted completion certificate issued by PSCST, Chandigarh vide letter no. PSCST/CC/1042 dated 02/03/2020 intimating that the industry has constructed induced draft Brick Kiln with zig-zag firing as per the technology evolved by the Punjab State Council for Science & Technology. The Kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report (SPL-1253).
As per policy of the Board and in the light of Head Office Order No. 59 dated 02/02/2016, the consent cases of Orange Category units are to be processed without visiting them.
In view of the above, may if approved “Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the Brick Kiln for a period upto 30/09/2029 subject to the suitable conditions along with the special conditions as under:-
1. The project proponent shall comply with code of practice/directions issued by PSCST, Chandigarh.
2. The brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as a raw material for the manufacturing of bricks as per Head Office order no. 346 dated 1/8/2016.
3. The brick kiln shall get its stack emission analyzed as per policy of the Board.
4. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
5. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
6. The brick kiln will plant adequate trees around the boundary of the Brick Kiln.
7. The Brick Kiln shall use atleast 20% Paddy Straw Pellets as fuel with coal as per Board’s notifications no. 10/574/2022-STE1/443 dated 04/11/2022.
