It has been observed that AEE RO vide his note dated 25.4.2024 has mentioned in his starting para that the industry is a medium scale Red category industry but however, in the same note he has mentioned the competency as Member Secretary (Red category Large scale having total project cost less than 15 crore). Zonal office in reply to this office note dated 20.5.2024 has mentioned that the competency of the case lies with the Chairman being investment more than 15 crores. The case was forwarded to the Competent Authority and accordingly approval obtained as per the proposal of SEE ZO Bathinda.
The case was discussed with SEE ZO Bathinda on 31.05.2024. It was deliberated that the officers are not clear regarding the competencies as per the policy of the Board which causes delay in speedy disposal of the cases. It has further been observed that as per the recommendations of SEE ZO dated 17.5.2024 to issue show cause notice along with hearing before Chairman of the Board due to the reason that the industry has not submitted registered lease deed for the land for disposal of treated effluents to which industry has already submitted the reply dated 15.5.2024 (stands uploaded with AEE RO note dated 15.5.2024) which needs to be considered and commented upon by Zonal Office regarding requirement of submission of registered lease deed for disposal of treated effluent only which is the sole reason for issuing SCN along with hearing before the Chairman of the Board. The detailed comments along with recommendations be submitted on this specific issue before issuing notice of hearing as already approved by the Competent Authority.
