File Note: The point wise reply of the observations raised by the Competent Authority are as under: 1. Regional Office has recommended the consent/restoration with the condition that the stone crusher shall comply with the complete code of practice before commissioning of the operation of the stone crusher. From this condition it seems that the stone crusher is yet to comply with the code of practice fully. If so, ask the industry to fulfill the same and then submit application for consent/restoration. 2. If the stone crusher is fully complying with the code of practice prescribed by the board, then regional office to submit a certificate to the effect. 3. Regional Office shall also confirm that the violations due to which disconnection orders were issued, have now been complied with. 4. Regional Office to check and that the industry has legal source of raw material viz-a-viz its production for which consents applied. 5. As competency to decide the consent case is with regional office, it shall first principally approve the consents (without pushing approval button) and then place the case for restoration of electric connection for the approval of competent authority. 1. The condition was imposed that the stone crusher shall ensure to continue complying with the code of practice prescribed for stone crushers. 2. It is certified that the stone crusher was seen fully complying with the code of practice prescribed as observed during the visit on 25.04.2024. 3. The stone crusher has now been complied with the violations due to which disconnection orders were issued. 4. As per letter issued by Principal Secretary Mines and Geology vide addressed to the worthy Chairman of the Board vide no. 521/Mining/E-371585 dated 21.10.2022, wherein mentioning that: It has come to the notice of the Department that the crushers in the state are procuring raw material from different sources. Hence limiting crushers owners to define the source of raw material would created un-necessary hurdles and paper work. Moreover, the source of material cannot be fixed for any crusher as they are free to source legal material at best competitive rates and the source of materials may change accordingly. Thereafter, asking crusher owners to submit the information pertaining to "legal Source of Raw Material" would be duplicity of efforts, accordingly, the stone crusher has not been asked for legal source of raw material. 5. It is restoration case, the consent to operate has already been approved by Addl. Senior Environmental Engineer for six months and the same will be issued upto the date for which restoration will be granted by the Competent Authority. Submitted please.
