The pointwise reply is as under:-
1. After considering all the court cases pending in the matter of brick kilns, the Board has issued office order vide no. SEE, HQ-2/2018/606 dated 18.12.2018, wherein it has been decided that the brick kilns which have adopted induced / high draft zig-zag technology certified by PSCST or other technology provided approved by PPCB, the consent to operate shall be granted as per policy of the Board with one of the special condition that the consent to operate is subjected to order passed by the Hon'ble High Court for states of Punjab and Haryana/Hon'ble NGT or other judicial authorities in the cases pending or being filed with regard to the subject matter of office order. Thereafter, consent to operate under the Water Act, 1974 and the Air Act, 1981 was granted to large number of similar brick kilns.
2. Lastly, a meeting was held under the chairmanship of Worthy Chairman of the Board on 09.04.2024 to decide the consent applications of BKOs which are not using 20% paddy straw pellets as a fuel and after detailed deliberations, it was decided that the brick kilns shall be granted consent to operate as per policy of the Board.
3. Lease deed is attached. As per lease deed, the deed is being issued between Sh. Soan Singh s/o Sh. Mehar Singh, Village Dhudian, Tehsil Moonak, District Sangrur and M/s Guru Nanak Dev Bricks Co., which is valid upto 24.05.2032 having land area 16 kanal.
4. The brick kiln has adopted Zig-Zag technology and thus, it has applied varied consent/CTO instead of renewal.
5. No, as per record file no action is pending against the brick kiln.
It is therefore recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may both be granted up to 30/09/2030 (upto adequacy of fee) for manufacturing of Bricks and Tiles @ 20000 Numbers/Day by using Clay & Soil @ 50 Metric Tonnes/Day as raw material under orange category subject to certain conditions to be mentioned therein and a special condition that the industry shall replace at least 20 % coal with paddy straw pellets as per directions issued by the Government vide notification dated 4.11.2022.
