It is submitted that the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/PTA/2019/10209193 dated 17/06/2019, valid upto 30/09/2024 and under the Air (Prevention and Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2019/10209060 dated 17/06/2019, valid upto 30/09/2024 for manufacture of Raw Rice (without drier) @ 2.0 T/Hour by using Paddy @ 3.0 T/Hour under orange category subject to conditions mentioned therein.
As per the submission made by the industry, it is informed that Sh. Prem Chand S/o Sh. Hukam Chand, one of the partner of the rice sheller, died on date 30.03.2024, which has been now retired from the firm due to death on 30.03.2024. Now, the firm wants to admit Sh. Deepak Kumar S/o Late Sh. Prem Chand as partner to run the same business under the same name and style of M/s Kumar Rice Mills.
Now firm has submitted a new partnership deed Sh. Satish Kumar S/o Sh. Lachhman Dass and Sh. Deepak Kumar S/o Sh. Prem Chand, who is the legal heir of said Sh. Satish Kumar, into the partnership w.e.f. 22.04.2024.
Accordingly, the industry has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention and Control of Pollution) Act, 1981 for manufacture Raw Rice (without drier) @ 2.0 T/Hour by using Paddy @ 3.0T/Hour under orange category along with requisite documents.
The industry has already deposited Rs. 18000/- vide UTR No. 790337781 dated 23.05.2024 as water consent fee and Rs. 18000/- vide UTR No. 729600267 dated 23.05.2024 as air consent fee, which is adequate upto 30.09.3034 against the fixed assets of Rs. 18.81 lakh as per CA certificate dated 16.05.2024 submitted by the industry.
The industry has submitted compliance report of consents conditions under the Water Act, 1974 and the Air Act, 1981earlier granted to it.
In this case, the industry has only changed its partners and there is no change in its raw material / product or any machinery, hence, no fresh visit is required at this stage and the industry not in operation due to off season and visit will be made in due course of time.
The industry has also submitted stack emissions sampling reports and analyzed by NABL Approved Laboratory on 02.05.2024. As per the report, the concentration of particulate matter is 285 mg/Nm3 (shelling section) against the prescribed limits 750 mg/Nm3, which is within the permissible limits as prescribed by the Board.
The industry is complying with the consents conditions under the Water Act, 1974 and the Air Act, 1981 granted to it.
Keeping above in view, it is recommended that fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention and Control of Pollution) Act, 1981 may be granted to the industry under the name of new partners upto 30.09.2034 for manufacture Raw Rice (without drier) @ 2.0 T/Hour by using Paddy @ 3.0 T/Hour under orange category subject to certain condition and following additional conditions that:
1. This consent is valid for manufacturing of Raw Rice @ 2.0 T/Hour by using Paddy @ 3.0 T/Hour. (without drier)
2. The rice sheller shall continue to abide by the new code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated. 15/10/2013.
I. All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories.
II. The industry should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the rice sheller.
III. All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 meters above the roof of the building.
IV. The industry shall not be located in High Tension Transmission Zone of Punjab State Power Corporation Limited.
V. The management and handling of rice husk in the rice shelling units should be done as under:
a. All the rice shelling units shall provide paved / brick roads / cement concrete roads/ metaled roads inside their premises for movement of vehicles, so as to prevent the generation of dust.
b. The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10' high or 3.5' higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35' on each side of the rice husk discharge pipe.
c. The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5'height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of airborne particulate from storage, handling and loading / unloading areas of rice husk.
d. The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15'' which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3' length.
e. Wherever the height of rice husk is 3' or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70 gm/m2 weight having 40-45 hole/inch2 to prevent wind blowing of stored husk.
f. During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds.
3. The industry is advised to obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).
4. The rice sheller shall put in place all the hoods, ductings& enclosures and other components of the APCD well before commissioning of the unit for the upcoming paddy shelling season and report the compliance in the regard to the Board prior to commissioning of the unit.
5. The industry will amend its APCD as per amendment (if any) in policy of the Board.
6. The industry shall provide additional plantation all along the boundary wall of the unit within 15 days and submit compliance in this regard to the Board immediately thereafter.
7. The industry shall keep the APCD in good running conditions at all the times and shall also operate the same properly and effectively so as to achieve the standards prescribed by the Board.
8. The industry shall dispose of the dust contained by APCD in an environmentally sound manner.
9. The industry shall make plantation in the open area, where the same is feasible, to contribute to increase in the green cover and shall inform the Board in this regard before commissioning of the unit before next shelling season.
10. The industry shall comply with the stack emissions standards as laid down by the Board and as amended from time to time by the Board/MoEF and shall be bound to upgrade/replace the APCD to achieve such revised standards.
11. The industry will shift to designated zone within the stipulated time or any amendment in the timeline as per the policy of the Govt.
12. The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken. |
