Sub: Proceedings of the personal hearing held before Senior Environmental Engineer, Zonal Office-2, Ludhiana for violation of provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 on 03.06.2024 - M/s Laj Overseas Unit-2, Adjoining area Focal Point Phase-7, Ludhiana.

On behalf of the industry

Environmental Engineer, Zonal Office-2, Ludhiana brought out that the industry is a small-scale orange category unit and is engaged in manufacturing of auto parts.
The industry was newly identified by the officer of the Board on 28.03.2024 and it was observed as under:
1. The industry was located the adjoining area of Phase-7, Focal Point, Ludhiana.
2. The industry was in operation during visit.
3. The industry has installed 02 no. hammer of capacities 2.5 tonne and 1.5 tonne.
4. The industry has installed 01 no. shot blast machine without adequate stack height.
5. The industry has also installed 01 no. BMC machine and other allied machinery.
6. The industry has installed 02 no. billet heater.
7. No trade effluent is generated by the industry and only domestic effluent is being discharged into MC sewer as informed by the industry representative.
8. The industry has failed to show any documentary proof regarding date of commissioning.
9. The industry is operating its unit without obtaining the consents of the Board. The industry is not complying with the provisions of the Water Act, 1974 and Air Act, 1981.
The industry is running its unit without obtaining consent to operate under the Water Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thus, the industry is violating the provisions of said Acts.
Show cause notice for violation under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 13.05.2024. However, no one from the industry attended the hearing.
The matter was considered by the Competent Authority and it has been decided to give another opportunity of personal hearing to the industry.
Show cause notice for violation under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 03.06.2024.
Sh. Dipesh Singh, Managing Director of the industry attended the hearing and submitted a written reply which was taken on record. Also, the industry has submitted letter from Senior Town Planner (STP), Ludhiana vide no. 3782 dated 15.05.2023 regarding suitability of the site of industry. He further informed that they have already applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
After hearing, the managing director of the industry and officers of the Board, the Senior Environmental Engineer of the Board decided as under:
1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted to the industry upto 30.09.2028 (i.e. adequacy of consent fee).
2. Regional Office shall check the authenticity of the letter submitted by the industry from Senior Town Planner (STP), Ludhiana vide no. 3782 dated 15.05.2023 regarding suitability of the site of industry.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please. |
