It is submitted that industry is a Medium Scale/ Orange Category unit and is engaged in the process of manufacturing of M.S.Round, Bars, Angles using M.S.Ingots, Billets, Blooms as Raw Material.
Earlier, consents to operate under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and Authorization under Hazardous & Other Wastes (Management Handling & Transboundary Movement) Rules, 2016 applied by the industry were refused to the industry as under with the following reasons: -
1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide No. CTOW/Renewal/LDH2/2024/24556977 dated 12.04.2024.
2. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide No. CTOA/Renewal/LDH2/2024/24557021 dated 12.04.2024.
3. Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 vie No HWM/renew/LDH2/2024/24841622 dated 12.04.2024.
Reasons of Refusal:-
1 The industry shall apply the TOR immediately and submit documentary proof to the Board, within 15 days.
2 It was made clear to the industry that if the industry fails to apply for TOR, then directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be confirmed.
3 Re-hearing be given to the industry after 15 days to review its compliance.
4 Environmental Engineer, Regional Office shall verify the submission of the industry and send its report before next date of hearing
In light of above said decisions, the industry was issued notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 alongwith show cause notice for violation of provisions of the Hazardous and other Waste Rules, 2016 with an opportunity of personal hearing before Worthy Chief Environmental Engineer, Ludhiana on 09.05.2024. Sh. D.K. Mehta, Authorized person from the industry attended the hearing and submitted that :-
(a) The industry is a Medium Scale/ Orange Category Rolling Mill and is engaged in the manufacturing of M.S. Round, Bars, Angles.
(b) The industry has applied for consent to operate under the Water Act, 1974 and Air Act, 1981 and authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016.
(c) The industry has also applied for TOR.
(d) The industry has made proper arrangements for collection and storage of hazardous waste & has got lifted old hazardous waste to TSDF Nimbua.
After hearing it was decided as under:-
1. The industry shall operate the APCD properly and efficiently as to achieve the prescribed standard of the Board.
2. The industry shall maintain the record regarding regular operation of APCD.
3. The industry shall maintain the record regarding the generation and disposal of Hazardous waste of all categories.
4. The Environmental Engineer, Regional Office shall verify the submissions of the industry and send further recommendations in the matter.
To verify the facts at site to process the consent/authorization applications applied by the industry on 23.05.2024 under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, the industry was visited by the AEE (undersigned) on 28.05.2024 and observed as under: -
The point-wise compliance of the decisions of personal hearing is as under:-
1. The industry is operating it APCD properly and efficiently and is achieving the prescribed standard of the Board. Earlier, the stack emission sample of the industry was collected on 23.10.2023 and as per analysis report the concentration of PM found @ 51 mg/Nm3, which was within the prescribed limits fixed by the Board.
2. The industry is maintaining the record regarding regular operation of APCD.
3. The industry is maintaining the record regarding generation and disposal of Hazardous waste.
The other details of visit is as under: -
1. During visit industry as well as APCD installed by the industry was in operation.
2. The industry was using pulverized coal as fuel in its re-heating furnace.
3. Earlier, the stack emission sample of the industry was collected on 23.10.2023 and as per analysis report the concentration of PM found @ 51 mg/Nm3, which was within the prescribed limits fixed by the Board.
4. The industry has provided the Sub energy meter with its APCD and treading of the same was 83202.2 kWh during visit.
5. The industry is maintaining the record of operation of APCD.
6. The industry has installed the D.G.Set of 75 KVA with canopy and adequate stack height.
7. The industry has provided septic tank to treat the domestic effluent
8. The cooling water is re-circulated and treated domestic effluent is discharged onto land for plantation.
9. The industry has applied for ToR and has submitted the copy of computerised receipt (Proposal No. SIA/PB/IND1/469515/2024 dated 18.04.2024) in support of applied of ToR –to Govt. of India, Ministry of Environment, Forest and Climate Change (issued by the State Level Expert Appraisal Committee (SEAC), Punjab.
10. The industry has provided Hazardous Waste Storage Room of size 8'-6" X 9'- 6 " X 10'- 6 to store the hazardous waste.
11. The industry has made the agreement with M/s CTSDF Nimbua for lifting of Hazardous Waste of Category No. 35.1.
12. Out of previously generated Hazardous waste @ 13.175 Ton of Cat.NO. 35.1, 10.940 of has been lifted by M/S Re Sustainability Ltd., Village Nimbua vide Manifest No. 47422 dated 04.02.2024. Hence, 2.235 Ton hazardous was has been left to be lifted by CTSDF, NImbua from the previous generated Hazardous waste upto 04.02.2024. Now, total 7.1 Ton of Hazardous Was is lying stored in 355 Bags.
13. The spent oil of Category No. 5.1 @ 25 Lts was lying stored inside the Hazardous Waste Storage room.
14. It has provided danger sign outside the Hazardous waste storage room.
15. It has provided environmental data board of size 6’ X 4’ at the main gate of the industry.
16. The industry has deposited the consent fee as under:-
(A) Under Water Act, 1974

Rs. 86,400/- vide UTR No. N326222215917678 dated 22.11.2022
Rs. 76,100/- vide UTR No. N154243069738345 dated 02.06.2024 (including Rs.
500/- as form fee)
(B) Under Air Act, 1981
Rs. 1,40,400/- vide UTR No. N340211739950267 dated 06.12.2021
Rs. 93,600/- vide UTR No. N326222215908821 dated 22.11.2022
Rs. 75,600/- vide UTR No. N154243069726585 dated 02.06.2024
17. The consent fee deposited by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 is adequate upto 30.09.2029.
Keeping in view of the above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for 5 years with usual conditions and with the special condition that the industry shall comply with the conditions of Terms of Reference (ToR) followed by Environment Clearance as required under EIA Notification, 2006 and in accordance with MoEF notification No. S.O.3250 (E) dated 20.07.2022 and issued from time to time.
