File Note: It is submitted that subject cited industry is small scale rice sheller and was earlier granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide No. CTOW/Fresh/RPN/2019/9794881 dated 10.07.2019 & the under Air (Prevention & Control of Pollution) Act, 1981 vide No. CTOA/ Fresh/RPN/2019/10105261 dated 10.07.2019 both are valid upto 30.06.2024 for processing of paddy @ 3 TPH in the name of Sh. Satpal. Now, Sh. Parshant Garg, Partner has applied fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for transferring the consent to operate in his name alongwith the requisite documents and consent fee. The industry has submitted the power of attorney/retirement cum admission partnership deed dated 24.07.2023, analysis report, Jamabandi, udyam registration certificate, authorized letter, CA certificate dated 31.03.2024 wherein the Capital Investment of the industry is of Rs. 146.46 Lakhs with the value of Plant & Machinery as Rs. 75.53. As per the record file, the fee deposited by the industry is adequate upto 30.06.2024. Now, the industry has deposited consent to operate Rs. 42000/- vide UTR no. P143240324292645 dated 22.05.2024 under Air Act, 1981 and Rs 42,000/- vide UTR no. P143240324299870 dated 22.05.2024 under Water Act, 1974. The fee deposited by the industry is adequate upto 30.06.2029. Further, the industry has submitted the stack emission from Centre for Environment and Food Technology Pvt. Ltd dated on 14.05.204 and as per the analysis results, the industry is conforming to the prescribed standards, the results are tabulated as under: Sr. no. Parameter Results Prescribed Standards 1. Particulate Matter (PM) (mg/Nm3) 327 750 Further, the industry has submitted compliance report of conditions of previous consent to operate granted to it under the provisions of the Air Act, 1981 and the Water Act, 1974. It is worth to mention here that as per the Office Order dated 02/02/2016, it has been asked to process the cases of Orange and green category of industries solely on the undertaking submitted by the industry. Since the project proponent has submitted the compliance report of the conditions imposed in the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, the same may be considered as good as the undertaking to the effect that it is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. In view of above, it is recommended that Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.06.2029 subject to the same condition and following additional conditions are under: 1. The consent to operate is granted on the basis of compliance report submitted by the industry. If upon subsequent visit the industry is found violating the provisions of the Environmental Laws, action deemed fit against the industry will be initiated without affording any opportunity of show cause. 2. The industry shall operate its APCD regularly and efficiently. 3. The industry shall not discharge its untreated domestic effluent outside the premises in any case. 4. The industry shall continue to comply with the code of practice prescribed for rice shellers by Govt. of Punjab Order No.10/48/2004/STE(4)/932 dated 15.10.2013 alongwith amendments issued by the Board under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. 5. The industry will be bound to upgrade its APCD as and when asked for by the Board/Govt. time to time to control the emissions generated from the process. 6. The consents granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981, may be revoked if found violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
