Sub: Proceeding of the personal hearing given before the Chief Environmental Engineer, Ludhiana on 06.06.2024 w.r.t Show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s S.S Concast Private limited Unit-3, Village - Panjetha, Machhiwara Road, Kohara, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted consent to operate under the Water Act, 1974 and Air Act, 1981 both valid upto 30.09.2027 for manufacturing of Steel Ingot Alloys and Non-alloys @ 85 MT/day.
The industry has obtained Environmental Clearance vide no. SEIAA/PB/IND/2023/EC/14 dated 24.11.2023 to enhance the capacity of unit for manufacturing alloys & non-alloys steel billets/ingots, steel round/hexas/square (RCS), flats/bars/patra, plates, wire rod etc. @ 1,38,600 TPA (after expansion) by upgrading the capacity of existing induction furnace from 7 Ton/heat to 8 Ton/heat and by installing another induction furnace of 25 Ton/heat and concast machine and Rolling mill in its existing premises.
Consent to Establish (NOC for expansion) under the Water Act, 1974 and Air Act, 1981 was granted to the industry for up-gradation of existing 7 TPH furnace to 8 TPH furnace vide no. CTE/Exp/LDH1/2024/24390068 Date of issue: 01/02/2024 Date of expiry: 31/01/2025.
The industry has now applied for obtaining consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 partially for up-graded furnace of capacity 8 TPH.
The industry was supposed to upgrade its septic tanks to meet with the increased domestic effluent after expansion.
The industry has not submitted the modifications/ upgradations made in the APCD of old 7 TPH furnace to make it capable to capture emissions of upgraded induction furnace of 8 TPH capacity.
The project proponent has not installed 24x7 continuous emission monitoring system at the inlet as well as at the outlet (stack) of each APCD to monitor the SPM concentration.
The industry is not completely complying with all the EC conditions granted to it by MOEF&CC.
In view of above, show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 was issued to industry with hearing before the CEE, Ludhiana on 06.06.2024.
Sh. Sachin Gupta, Director of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry has completed partial expansion as per the Environmental Clearance, upgrading existing 7 TPH furnace to 8 TPH. Due to this proposed expansion, there will be no additional manpower required, as such there will be no increase in the domestic effluent and existing septic tank is sufficient for the domestic effluent load. The industry was originally commissioned in the month of August 2022, considering the proposed expansion, an APCD of an adequate capacity was installed which is sufficient for the proposed expansion i.e. from 7 TPH to 8 TPH. Further, the industry has committed to enhance capacity of APCD before installation & commissioning of furnace having 25 TPH capacity. The industry has proposed to install 24 x 7 continuous emission monitoring system within 2 months.
After hearing the industry, officer of the Board and considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided as under:-
1. The industry shall obtain the completion certificate from the Punjab State Council for Science & Technology regarding up-gradation of APCD of induction furnace of 8 TPH capacity.
2. The industry shall install Online Continuous Emission Monitoring System (OCEMS), within 02 months.
3. The industry shall comply with all the conditions of Environmental Clearance granted to it by MOEF&CC.
4. The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for short term i.e. one year.
5. Environmental Engineer Regional Office shall visit the industry and submit the compliance of all the conditions of Environmental Clearance granted by MOEF&CC.
