Sub: Proceeding of the personal hearing given before the Chief Environmental Engineer, Ludhiana on 06.06.2024 w.r.t show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Happy Forgings Ltd Unit-III, Village - Dugri, Daburji Road, P.O Rajgarh, Block Doraha, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/LDH1/2022/18171075 dated 28/03/2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDH1/2022/18172600 dated 28/03/2022 both valid upto 31/03/2024 for manufacturing of Auto components & Non-Auto Components (Crank shaft, axle arm & beam, Differential Case etc.) @ 38000 MT/year with special conditions as under:-
1. The industry will not generate any trade effluent from manufacturing process without obtaining permission of the Board and this consent is granted for only dry process.
2. The industry will not commission its phosphating and painting section without obtaining NOC of the board.
3. The industry will do its proposed expansion only after obtaining NOC from the Board.
The industry has now applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The consent applications under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 has been perused and it has been observed as under:-
1. The industry has provided 2.2 Acres Land for disposal of effluent @ 230 KLD, which is not sufficient.
2. The industry has not submitted details of plantation area of 2.2 Acres provided for disposal of effluent @ 230 KLD.
3. The industry has not obtained permission from the PWRDA for ground water extraction.
4. The industry has also installed one automatic phosphating, painting section, 2 no. shot blast machines without prior permission of the Board in violation to conditions of earlier granted consent to operate.
5. The industry has significant increase of fixed assets around 100 crores. The industry has not submitted details of increase in fixed assets and details of additional machinery.
6. The industry is located in village Dugri and the industry has installed forging presses of capacities 14000 Ton and 8000 MT with billet heaters and failed to submit the noise monitoring analysis report.
7. The industry has not submitted point wise compliance of conditions of previous granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
8. The industry is generating huge quantity of cutting oil from processes and has not submitted disposal mechanism of the same.
Show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 was issued to industry with hearing before the CEE, Ludhiana on 09.05.2024. But, No one from the industry attended the hearing and not submitted any written reply.
In view of above, show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 was issued to industry with hearing before the CEE, Ludhiana on 06.06.2024.
Sh. Amninder Kaur, AGM of the industry attended the hearing and submitted written reply which has been taken on record. She submitted that there are approx. 750 no. of employees and the waste water generation of domestic effluent is 35-40 KLD approx. which is used for landscape maintenance of green areas (parks and plantation along boundary wall) as the industry is not in full operation. The industry has 1.8 acre of landscape maintained in 2 parks and along the boundary wall of the premises. Treated water is used for landscape maintenance. Also, the industry has 1 acre open land available for plantation to cover the future increase in domestic wastewater. The industry has applied for the grant of permission to extract groundwater to the concerned authority and is in progress. The industry has not commissioned the said automatic phosphating and painting section. The industry will apply consent as per the rules under the red category before commissioning painting section and phosphating. The industry has not installed polluting machinery. The industry has installed latest technology hydraulic presses with are fitted with shock absorbing shockers that reduces the vibration and are produce less noise as compared to old technology. Also the ambient noise monitoring is done annually to verify the noise levels. Point wise compliance of conditions of consent is attached. Every machine is fitted with a collection tank and inbuilt recirculation system. The coolant oil is diluted to 5-7% concentration and only top-up is done with water and coolant to maintain the concentration after measurement. However, there is some dropwise wastages with bur which is collected in bur collection trolley. The industry has made an agreement with M/s Aggarwal Manufacturing Co. for disposal of such waste.
After hearing the industry, officer of the Board and considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided as under:-
1. The industry shall operate its STP regularly and efficiently, so as to achieve the standards prescribed by the Board.
2. The industry shall provide adequate plantation area for discharge of treated effluent.
3. The Environmental Engineer, Regional Office-1, Ludhiana shall verify submissions made by the industry and send further recommendations in the matter.
