It is submitted that M/s Vig Agro Exports Limited, village Bhadarwala, Ferozepur is an existing unit and was granted consent to operate under the Water Act, 1974 and the Air Act, 1981 vide no. R15FZRCTOW2333065 dated 05.02.2015 and R15FZRCTOA2325781 dated 05.02.2015, each valid upto 30.09.2019, for manufacturing of parboiled rice /steamed rice @ 144 TPD and sorted rice @ 144 TPD, using paddy @ 216 TPD along with discharge of treated trade effluent @ 144 TPD onto land for plantation. Thereafter, the industry has failed to obtain renewal of consent to operate under the Water Act, 1974 and the Air Act, 1981.
Now, the firm M/s JeetVansh Agro has applied for fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for operation of existing plant of M/s Vig Agro Exports Limited for manufacturing of for manufacturing of steamed rice/raw rice @ 144 TPD and sorted rice @ 144 TPD, using paddy @ 216 TPD. Details of the case are as under:
1. The project proponent has registery dated 16.02.2024, wherein M/s Angel international, MandiGobindgarh has purchased M/s Vig Agro exports Pvt. Ltd. village Bahadurwala, tehsil and Distt. Ferozepur containing the land area and machinery. Total land area of 53 kanal 14 marlas,Land details are , 40 kanal, 06 marlas, in khewat no. 95, khatoni no. 104, Rect no. 23 kila 21/1(1-3) 21/2(3-0), Rect no. 29 kila 1(8-0) 10(8-0) 11/1(1-16), Rect no. 30 Kila4/2(0-3) 5/2(4-7) 6(7-18) 7(1-15) 15(4-14), land 12 kanal 17 marlas, in khewat no. 211 khatouni 233, Rect no. 29, killa11//2(6-4), 20(6-13).
2. The project proponent has submittedregsitery dated 29.02.2024, wherein , M/s JeetVansh Agro Foods has purchased rice shller unit at village Bahadurwala from M/s M/s Angel international, MandiGobindgarh, with land area of 38 kanals, bearing khasra nos. khewat no. 95, khatoni no. 104, 23//21/2(3-0), 29 kila 1(8-0) 10(8-0), 11/1(1-16), 30//15(3-16), khewat no. 211 khatoni no. 233, 29//11/2(6-4) 20(6-13), khatoni no. 234 kila no. 29//21(3-12)
3. The project proponent has submitted another transfer deed dated 19.04.2024, wherein the land area of remaining 15 kanal 14 marlas bearing khasra nos. 30//4/2(0-3), 5/2(4-7), 6(7-18), 7(1-5), 15 min (0-18), is to the name of Sh. VanshDhall, partner in M/s JeetVnash Agro firm.
4. The industry has submitted partnership deed dated 05.02.2024, wherein Sh. PardeepDhall, Sh. AashihDhall and Sh. VanshDhall are partners in the firm M/s JeetVansh Agro foods, village Bahadarwala, tehsil and District Ferozepur.
5. The industry has submitted intimation from Assistant Executive Engineer, Punjab State Power Corporation Ltd, Ferozepur City, wherein it has been mentioned that the connection account of M/s Vig Agro has been disconnected w.e.f from 01.04.2018, same was authenticated from the office of PSPCL Ferozepur City vide email dated 07.06.2024.
6. The industry has submitted CA certificate showing gross block of fixed assets as Rs. 527.50 lakhs. Accordingly, the industry has deposited Rs. 108000/- vide UTR no. N150243060194353 dated 29.05.2024 under the Water Act, 1974 and Rs. 108000/- vide UTR no.N150243060186969 dated 29.05.2024 and Rs. 18000/- vide UTR no. N150243060190515dated 29.05.2024 as NOC Regularization fee, which is adequate for a period upto 30.09.2028 under both Acts.
7. The industry has submitted an undertaking through its partner, which is reproduced as under:-
“That I, AshishDhall s/o Pardeep Kumar R/oTalwandiBhai, partner in M/s JeetVansh Agro Foods, states as under:
1. That we have purchased M/s JeetVansh Agro from M/s Angel group, which gave purchased M/s Vig Agro exports through bank Auction.
2. That we have purchased the already existing rice sheller unit, M/s Vig Agro exports with all its existing assets , i.e. land area, building, plant and machinery intact at the site.
3. That we will now operate M/s VigAgro exports with new name and style of M/s JeetVansh Agro, with the same existing land area, building and plant and machinery and same production capacity of M/s Vig Agro exports.
4. That we have not carried out any change in the already existing land area, building and plant and machinery of previous unit M/s Vig Agro exports and we only operate the earlier existing unit with new name and style of M/s JeetVansh Agro.
5. That we have applied for consent to operate under the Water Act and Air Act for operation of unit for manufacturing of Steamed rice/raw rice @ 144TPD ( same production capacity of previous industry M/s Vig Agro Exports) and will not operate Saila plant.
6. That we have removed the hot water supply line to Handis so as to rule out any possibility of operation of Saila section.
7. That we will obtain prior permission of the Board before operating the Saila section.”
The industry has already been visited by undersigned (AEE) on 21.05.2024 and it was observed as under:-
• The industry was not in operation for any activity. Already existing land area, building shed and plant and machinery of the earlier unit, M/s Vig Agro Exports Ltd. were intact and the project proponent was in the process of repair and renovation of the existing machinery and cleaning of the site.
• The industry has installed multicyclone as APCD to contain flue gas emissions from 06 TPH capacity rice husk fired boiler and stack of adequate height has been provided with infrastructure to facilitate emission sampling.
• The industry has installed cyclones as APCDs with pre-cleaning section of parboiling plant and rice shelling section, separately with stacks of adequate height and provisions to facilitate emission sampling.
• The industry has provided pipeline for taking rice husk from husk discharge point to boiler feeding point and mechanical feeding system has been provided with furnace of boiler.
• The industry has removed pipeline carrying hot water to the handies so as to rule out the possibility of production of saila rice.
• The industry has provided room type enclosure with roof of adequate size for storage of fuel ash alongwith arrangement for wetting of fuel ash to avoid its blowing.
• The industry has provided brick paving at movement area of vehicles, within its premises.
• The industry has planted trees along its boundary wall.
• The industry has provided septic tank for treatment of domestic effluent.
• There has been no change in the land area, plant and machinery and building shed of the industry as that of the earlier existing unit M/s Vig Agro Exports Ltd.
The industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981 as well as code of practice prescribed by the Govt. order dt.15.10.2013.
Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the new firm, M/s Jeet Vansh Agro Foods, village Bahadarwala, tehsil and District Ferozepur for operation of steamed plant/rice sheller unit to manufacture steamed rice/raw rice @ 144 TPD and sorted rice @ 144 TPD (same production capacity as that of M/s Vig Agro Foods Exports Ltd.), under Orange category, subject to the suitable conditions and a specific condition as under:
1. The industry will not operate its Saila section without obtaining prior permission (consents to operate) of the Board.
2. The industry shall not carry out any change in the plant and machinery as well as production capacity of the unit without obtaining prior permission of the Board.
3. The industry shall get its emissions analyzed from Board's lab, during coming paddy season 2024-25.
