It is submitted that the industry was earlier granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2019/10840879 dated 12/09/2019 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2019/10840792 dated 12/09/2019, both having validity upto 30/06/2024, for manufacturing of X-ray machines (different types) @ 840 Number/year by using Electrical Parts @ 208260 Kg/Year, Electronics Parts 208260 Kg/Year, Metallic Parts 277680 Kg/Year, with certain conditions.
Now, the project proponent has applied for renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, with same products along with requisite documents.
Fee details:
The project proponent has deposited consents fee of Rs. 268100/- vide UTR. No. HDFCR52024051557288602 dated 15.05.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 246000/- vide R. 247271277 dated 10.05.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.06.2029 under both acts and considering NOC regularization fee against the increased fixed assets of Rs. 1062.67 lakhs to Rs. 2043.14 lakhs. Further, the industry has the increase of its fixed assets is due to the following: “Regarding increase in the value of fixed assets, please note that the increase in due to:
1. Value increase in building cost is due to construction of storage shed, renovation of office and existing building, replacement of sheets-revised drawing got approved from Director of Factories, Punjab. Copy enclosed
2. Value of increase in plant & machinery is mainly due to addition of CNC machines and other fabrication machinery, replacement of phosphate treatment tanks, installation of firefighting system and purchase of material handling equipment and other various machinery accessories.
3. The addition of other assets i.e. due to installation of solar system.
Details of Bank Guarantee:
As per the record file of this office, there is an existing bank guarantee submitted by the industry, amounting to Rs. 50,000/- bearing no. 05740ILG004524 dated 30.05.2024, which is valid upto 31.05.2025.
It is worth to mention here that the site of the industry is located within limits of MC Derabasssi and Master Plan of Derabassi The industry has submitted a copy of letter issued by Municipal Council, Derabassi vide letter no. 3107 dated 04.09.2019, wherein it has mentioned as under

Thus, the site of the project is suitable to continue operation at the site. Further, the industry shall be required to comply with the by-laws of Master Plan, Derabassi as well as the guidelines of Department of Town & Country Planning, at all times.
Visit:
The site of the industry was visited by AEE of this office on 23.05.2024 and it was observed as under:
1. The industry was in operation and is engaged in the business of manufacturing of medical equipment involving processes such as fabrication, surface treatment and paint operations etc.
2. The source of fresh water supply is tubewell and it has been provided its flow meter to adjudge the quantity of water being abstracted by the industry. The industry is maintaining record of the readings of the same.
3. The industry engaged in phosphating process for which it has installed 02 no. 02 no. water02 no. derusting tanks03 no. rinsing tanksdegreasing tanks 01 no. 01 no. zinc phosphating tank01 no. activation tankrinsing tanks 01 no. passivation tank water rinsing tank.
4. The industry has install ETP plant for the treatment of trade effluent generated from the phosphating section. The industry has installed electromagnetic flow meter at the inlet as well as outlet of the ETP and is maintaining the record of operation of the ETP and treated wastewater discharged by it.
5. During visit, effluent sampling from outlet of ETP was carried out and sent to Head office Lab, Patiala. The analysis results from HO lab, Patiala are awaited. Further, alongwith the online application the industry has submitted effluent sampling of the ETP (Outlet) Water report carried out by M/s Centre for Environment and Food Technology Pvt. Ltd., collected on 14.05.2024 and tabulated as under:

6. The treated wastewater is utilized onto land for plantation area developed inside the industrial premises as per Karnal Technology developed in an area about 483 sqm land area. The industry is also utilizing the treated wastewater onto land for green lawns developed inside its premises.
7. The domestic wastewater generated from bathrooms and canteen is being sent to the STP installed in the premises of its sister concern for treatment and is utilized in the plantation area developed therein.
8. The industry has installed water scrubber as APCD with paint booth to control the process emissions. The industry has also installed cyclone with the powder coating section as APCD to contain process emissions within the prescribed standards laid down by the Board.
9. The industry has submitted the analysis results of the stack emission sample of the process stack of powder coating booth got analyzed by M/s Centre of Environment and Food Technology Pvt. Ltd., collected on 29.04.2024 and tabulated as under:

12. The industry has installed two DG sets of capacity 125 KVA and 82 KVA, which are equipped with canopies and stacks of adequate heights
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the ‘consent to operate’ granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, may be renewed upto 30.06.2028 with usual conditions & with following special conditions:
1. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard.
2. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
3. The industry shall regularly operate and maintain its ETP and ensure that the treated sewage conforms to the effluent standards prescribed by the Board / Ministry of Environment and Forests & Climate Change for such discharges.
4. The industry shall keep adequate plantation area developed as per green area for disposal of treated wastewater in good conditions, at all the times.
5. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
6. The industry shall maintain proper record of consumption of fresh water, generation of trade effluent and disposal of treated wastewater, at all times.
7. The industry shall ensure that the activities of unit does not create any air pollution/ nuisance in the surrounding areas and no public complaints are received.
8. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
9. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
