Details of the case may kindly be pursued in the note of AEE.
In view of the said details and recommendations of EE, RO, SAS Nagar, if approved, before taking any further action in the matter, legal opinion from SLO of the Board may be obtained to the effect that as to whether Board can grant consent to operate under Water Act, 1974 & Air Act, 1981 to the project proponent for organizing marriage functions and other parties without CLU and site suitability.
Also, his opinion may be taken as to whether at this stage, prosecution can be launched against M/s The Hermitage, Village Karoran, Tehsil Kharar, District SAS Nagar for not complying with the provisions of the Water Act, 1974 as matter is pending in the Hon’ble National Green Tribunal.
EE, RO may be asked to depute concerned AEE to visit the office of SLO to apprise the case and get the opinion at the earliest so that application can be decided on merits.
