File Note: It is intimated that the industry is a small scale red category dyeing unit and was granted consent to operate under Air Act, 1981 vide no. CTOA/Renewal/LDH3/2023/21876663 dated 15.09.2023 for the production of PC/Cotton Fabric Dyeing @ 6 Tonne/day & Polyester Fabric Dyeing @ 12 Tonne/day with operation of one no. boiler of capacity @ 8 TPH with separate cyclones followed by double stage wet scrubber as APCDs with common stack, which is valid upto 14.09.2024. Thereafter, the industry was visited by officers of this office on 19.12.2023 to verify the complaint received from the office of Sh. Madan Lal Bagga, MLA, Ludhiana (North) regarding problem of fly ash and black emissions in the area around Bahadurke Dyeing Complex. During visit it was observed that:- 1. The industry was using rice husk after mixing with other agro waste i.e. shredded paddy straw as fuel in its boiler, whereas consent to operate has been granted to the industry for using rice husk only as fuel. During visit fuel ash was found here & there all around the boiler section as well as industrial premises and the fuel ash handling of the industry was very poor. Emissions were also observed from feeding side of boiler inside the shed. 2. The industry has provided a fuel ash discharged point outside the industrial premises along the roadside to load the fuel ash directly into trollies for the disposal of the same at unknown place. During visit, loading of fuel ash was being done in trolly outside the industrial premises. Accordingly, notice u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 alongwith show cause notice for cancellation of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 was issued with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 23.01.2024. After hearing Competent Authority of the Board was decide as under:- 1. Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 be cancelled. 2. Another opportunity of hearing be afforded to the industry by issuing notice u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be issued to the industry. Accordingly, the consent to operate under Air (Prevention & Control of Pollution) Act, 1981 was cancelled vide Board's letter no. 836 dated 06.02.2024. Thereafter, industry was given opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 alongwith show cause notice for cancellation of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 on 28.02.2024. After hearing Competent Authority of the Board was decide as under:- 1. The industry shall not burn loose agro waste in its boiler without getting its APCD assessed for its adequacy from an institute of technical repute. 2. The industry shall submit, within 07 days, a Bank Guarantee of Rs. 25,000 /- as an assurance not to emit black smoke from its furnace, at any time in future. 3. The Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry on surprise basis three times and recommend further action in the matter for release of Bank Guarantee accordingly. 4. It was made clear that in case the industry is found emitting black smoke, the Board shall feel constrained to confirm the proposed directions without any further notice/ opportunity. Now, the industry has applied for fresh consent to operate under Air Act, 1981 for production of Polyester Fabric Dyeing @ 12 T/day and PC/Cotton Fabric dyeing @ 6 T/day with operation of one no. boiler of capacity @ 8 TPH with separate cyclones followed by double stage wet scrubber as APCDs with common stack. The industry has deposited Rs. 72,000/- vide UTR no. N175211542451222 dated 24.06.2021 and Rs. 36,000/- vide R no. 670516710 dated 11.03.2024 under Air Act, 1981, which is adequate upto 30.06.2027. The industry has submitted certificate issued by STP Ludhiana letter vide no. 1126 STP (L)/TW/2A dated 03.04.2018 stating that the site of the industry falls under industrial zone as per Master Plan, Ludhiana. The industry has submitted approved building plan approved by the Directory of Factory, Punjab. The industry has submitted bank guarantee of Rs. 25000/- in this office. The industry was visited by officer of this office on 07.06.2024 and observed as under: 1. The industry was in operation and has installed 10 soft flow machines of total capacity 4200 Kg i.e. (1X800 Kg), (2X400kg), (3X500kg), (3X300kg) and (1X200kg) inside the premises. 2. The industry has installed one no. boiler of capacity @ 8 TPH with separate cyclones followed by double stage wet scrubber as APCDs with common stack. During the visit, industry was using rice husk as fuel in the boiler and stack of the boiler was clear as no black smoke was being emitted from the boiler. 3. Industry has now shifted fuel ash discharge point inside the premises. Industry has removed all discrepancies, which were earlier observed during the complaint. 4. The industry has installed one DG set of cap. 380 KVA, which is equipped with canopy and adequate stack height. 5. The industry is complying the provisions of Air (Prevention & Control of Pollution) Act, 1981 In view of above, it is recommended that consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for the period of 01 year with special condition that the industry shall got analyzed its air emission samples from the Board's lab within this period.
