RO has reported that the consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & control of Pollution) Act, 1981 was granted vide online reference no. O16PKTCTOW4053446 & O16PKTCTOA4053444 dated 24/08/2016, which are valid upto 30/09/2021 respectively under orange category and same has been revoked vide no. 6937 dated 19.12.2019. It is further intimated that personal hearing before the Chairman of the Board on 17.10.2023 in reference to Notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act 1974 as amended in 1988, whereas it was decided as under:- 1. The Resort shall submit a B.G. amounting Rs. 50,000/- to the Board as an assurance to comply with Environmental Pollution Control Laws within 15-days. 2. The industry shall appoint a technical person for the O&M of STP. 3. The Resort shall apply for Consent to Operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with complete documents through online system within 15-days. 4. The Regional Office shall collect the effluent samples from Board's lab and process the consents applications of the Resort on merit. Now, the industry has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for the operation of Hotel & Resorts through OCMMS in a totally paperless manner by uploading necessary documents as PDF. The industry has deposited Rs. 1,92,500/- vide UTR No. 825385736 dated 03/06/2024 & Rs. 2,28,000/- vide UTR No. 335414999 dated 03/06/2024 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as Form Downloading fee against total gross value of fixed assets worth Rs. 16,31,51,200/- as on 31/10/2023 and same are adequate upto 30/09/2028 under both Acts. The industry was visited by AEE on 05/06/2024 and observed as under:- 1. The industry is a Hotel Cum Restaurant Comprising with 36 no. Rooms & One no. Restaurant. However, during visit, the Hotel was being renovated and as informed by the project proponent, after the COVID-19, the condition of the resort was deteriorated and due to which the renovation work is being done and the resort has not been operated properly. 2. The industry has provided STP for the treatment of domestic effluent generated from its domestic activities. However, due to non-operation of resort, there was no effluent generated. 3. The industry has provided adequate arrangement for storage/disposal of Municipal Solid Waste. 4. The industry has installed 02 no. D.G. sets of capacity 150 KVA & 82.5 KVA, which are provided with canopies and adequate stack height.
It was discussed telephonically with EE RO about the deposition of BG of Rs.50,000/- and EE RO told that the PP has deposit BG of Rs. 50,000/-
RO has recommended that the Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2028 with suitable conditions along with the special condition that the project proponent shall inform the Board as and when it comes in operation so that effluent sampling be carried out from the outlet of the STP.
In view of above, the Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2028 with suitable conditions along with the special condition that the project proponent shall inform the Board as and when it comes in operation so that effluent sampling be carried out from the outlet of the STP.
