The industry is a small scale red category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/LDH1/2023/24375502 dated 13/12/2023 valid upto 12/06/2024 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDH1/2023/24376521 dated 12/12/2023 valid upto 11/06/2024 for manufacturing of Electroplating and powder coating of Agriculture / Auto parts / Tractor Parts / cycle parts etc @ 500 Nos/day.
The Competent Authority of the Board vide letter 7178-79 dated 13.012.2023 has decided to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 for restoration of electric connection available to the industry/ premises temporarily for six months i.e. upto 12.06.2024 as under:
"That the authorities concerned shall restore the supply of electricity available to the industry/ premises temporarily for six months l.e. upto 12.06.2024 with immediate effect."
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 4.92 Lacs 31/03/2024 as per CA Certificate dated 06/06/2024, which is adequate upto 31/03/2028 under Water Act, 1974 and Air Act, 1981, as per Board's Office Order dated 29/10/2018.
The industry vide its letter dated 11.06.2024 has submitted a request for permanent restoration of electric connection, which is reproduced as under:
“We were operating our unit without having 'Consent to Operate' from the Board, therefore, the Board vide letter no. 6253-54 dated 30.10.2023 has issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 for disconnection of electric connection. Further, we had applied 'Consent to Operate' of the Board and Board has restored our electric connection upto 12.06.2024. Now, we have applied further 'Consent to Operate'. We are complying with Environmental laws. Please restore our electric connection permanently.”
The industry was visited by the undersigned on 11.06.2024 and it was observed as under:
1. The industry is a small scale red category industry and was engaged in electroplating and metal finishing processes.
2. The industry has installed water meter in its process area and reading noted during visit was 56.61 KL.
3. The industry has made collection tank of capacity 5000 ltr for the collection of effluent generating from electroplating section.
4. The industry has made agreement with CETP at Phase-8, Focal Point, Ludhiana operated by M/s JBR Technologies Pvt. Ltd. for 4000 liters/month.
5. The industry is maintaining record regarding fresh water consumption and effluent lifted to CETP.
6. The industry has installed 1 no. powder coating booth with cyclone as APCD.
7. The industry has provided electric oven with adequate stack height.
8. Domestic effluent generated by the industry is discharged into sewer.
9. The industry is maintaining record w.r.t. fresh water consumption for the wet process & effluent lifted to M/s JBR Tech. Pvt Ltd. The record is reproduced below:

Water consumed: 17.20 KL 16.8 KL 5000 ltr. 1500 ltr 500 ltr. on 29.05.2024 15 days 4000 ltr.
As per the record the quantity of water consumed for wet process is in consonance with the quantity of effluent lifted to JBR Tech. Pvt. Ltd.
10. The industry has not installed any DG set.
In the subject cited case, the industry has mentioned ground water extraction @ 0.626 KLD. Considering 25 working days per month, ground water extraction will be 15.65 KL/month, which is less than 300 KL/month.
It is therefore recommended that 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30/06/2027 with suitable conditions as per policy of the Board and PSCPL authorities may be directed to permanently restore its electric connection.
