Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 11.06.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Rita Alloys, B-29-II- Kanganwal Road, Jaspal Bangar, Industrial Area-C, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is small scale red category unit and was granted consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 upto 19/03/2025 for installation of 01 no. Induction Furnace of capacity 1 T/heat, 01 no. cupola furnace, 02 no. D.G sets (250 KVA & 50 KVA).
The industry has now applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for installation of Induction Furnace of capacity 1 T/heat and one cupola furnace.
The application of the industry has been perused and it has been observed as under:-
1. The industry has not submitted the analysis report of air emissions of induction furnace as well as cupola furnace.
2. The industry has not submitted the compliance of SOPs prescribed for such type of units by Punjab State Council for Science & Technology.
3. The industry has not submitted the detail of re-circulation system of cooling water.
4. The industry has submitted provisional Completion certificate of APCD with Induction furnace from PSCST and failed to submit final certificate of APCD from PSCST.
5. The industry has not submitted verified Compliance Report of conditions of NOC granted to it.
6. The industry has not applied for authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016.
The industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 11.06.2024.
Sh. Kulbhush Mehta, Manager of the industry attended the hearing and submitted written reply which has been taken on record. The industry has submitted the copy of Completion certificate for coupla furnace from the PSCST. The industry has submitted the compliance of SOPs for induction furnace prescribed by Punjab State Council for Science & Technology. They have also given detailed re-circulation system of cooling water. The Compliance Report of conditions of NOC granted is submitted by industry. They are in contact with Nimbua Greenfield for agreement and after getting agreement from them, they will apply for authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016. The industry has already submitted provisional Completion certificate of APCD with Induction furnace from PSCST and will submit final certificate of APCD from PSCST, one month.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry upto adequacy of consent fee.
2. The consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for 03 months with special condition that the industry will submit the final Completion certificate of APCD with Induction furnace from PSCST during this period.
3. The Environmental Engineer, Regional office shall verify submissions of the industry and send further recommendations in the matter.
