No. 137, Alimajra, Rajpura, Distt. Patiala. The Following were present: - On behalf of Punjab Pollution Control Board 1. Er. Lavneet Kumar, Senior Environmental Engineer (ZP-1) 2. Er. Navtesh Singla, Environmental Engineer (ZP-I) On behalf of the Authority 1. Sh. Atul Singh Tyagi, Designated Partner At the outset, Environmental Engineer, (ZP-1) brought out that: - The establishment was granted consent to establish vide CTE/Fresh/PTA/2021/16810208 dated 21/10/2021, valid upto 05/10/2022 for establishment of warehouse in an area measuring 34580.38 Sqm, having built up area of 19648 Sq.mt/day under orange category with suitable conditions mentioned therein. The project proponent has applied for obtaining fresh consents under the Water Act, 1974 and under the Air Act, 1981 for operation of the warehouse under green category. The site was visited by the officers of the Board on 26.02.2024. During visit, it was observed that: 1. The establishment is a warehouse project and found in operation. 2. The establishment has provided 2 no. of sheds. 3. The representative of the project informed that 1 no. of shed which is having built up area of 2.2 lac sq.ft. is complete and is 70% occupied by M/s Mahindra & Mahindra and other shed of built up area @ 1.8 lac sq.ft. is under construction and is lying vacant. Therefore, the total built up area will be 4.0 Lac sqft (approx. 37162 sqm). 4. He further informed that waste water from domestic source is collected in septic tanks & will be lifted by movable tankers after filling. It is evident that the project proponent is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as conditions of the NOC granted to it by the Board. Thus, will fully causing water pollution in the vicinity by violating the provisions of the said Act, intentionally and deliberately. Show cause notice for refusal of consent to operate applied by the project proponent under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was issued to the establishment vide Board letter no. 12698 dated 14.03.2024 with an opportunity to reply within 15 days. The reply submitted by the warehouse was found not satisfactory. As such, the consents to operate applied by the warehouse under the Water Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 were refused vide no. CTOW/Fresh/PTA/2024/19808976 dated 31.03.2024 and vide no. CTOA/Fresh/PTA/2024/19801243 dated 31.03.2024, respectively. The project proponent has again applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 without submitting any compliance. Moreover, the project proponent in its latest application form has not mentioned any detail regarding the total built up area and details regarding consumption, generation and disposal of fresh water as well as wastewater, is kept blank. The project proponent is still not complied with the provisions of the Water Act, 1974 and the Air Act, 1981 and continuing violating the provisions of the said Acts, intentionally and deliberately. As such, show cause notice for refusal of consents to operate applied by the project proponent under the provisions of the Water Act, 1974 & the Air Act, 1981 was issued vide Board's letter no. 1057dated 22/05/2024 alongwith opportunity of personal hearing before the Chief Environmental Engineer (P) Punjab Pollution Control Board, Vatavarn Bhawan, Nabha Road, Patiala on 31/05/2024 at 11.00 AM. The project proponent attended the hearing and submitted that there are two entities namely M/s ASAP Logistrics LLP and other is M/s Swift Logistics LLP. Both these entities are having separate CLU/ building plans and other permissions. The project proponent claimed that the visiting officer has not checked the premises properly and has given vague data. The written reply submitted by the project proponent has taken on record. After hearing the officer of the Board, representative of the project proponent and material facts on the record, the Chief Environmental Engineer (P) decided as under: 1. Environmental Engineer, Regional Office, Patiala shall personally visit the site of the warehouse and verify the contentions made by the project proponent during the hearing, check the compliance of the Environmental Laws, within 7-days and submitted its report alongwith concrete recommendations to decide the application. 2. Further action shall be taken after the receipt of the report from the Regional Office. If approved, proceedings may be conveyed to the industry as well as Environmental Engineer, Regional Office, Patiala for compliance.
