It is submitted that the subject cited industry is a small scale red category unit and applied for obtaining 'Consent to Operate' under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 24.08 Lacs as on 31.03.2024 as per CA certificate dated 12.04.2024, which is adequate upto 31.12.2027 as per Board's Office Order dated 29/10/2018.
The industry was given personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.06.2024 w.r.t. show cause notice for refusal of 'Consent to Establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, wherein, it was decided as under:
1. The industry shall regularly lifted the spent acid to CETP operator regularly and maintain the record of water consumption and lifting.
2. The industry shall submit the record of six months of water consumptions and lifting to Board in annotated form within 15 days.
3. The application for 'Consent to Establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be refused.
4. The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 07 days.
5. The Environmental Engineer, Regional Office, Ludhiana shall verify the submission made by industry and process consent applications on merits.
The industry was visited by the undersigned on 15.05.2024 and it was observed as under:
1. The industry was in operation.
2. The industry is engaged in manufacturing of Washers, Nuts and other Auto Parts @ 2.5 MTD by using raw material as MS Plate 2.5 @ MTD, SS Plate 0.2 @ MTD, HCL Acid @ 25 Ltr/Day, Nitric Acid @ 1.0 Ltr/Day, M&R, Brightner & Passivation Dip @ 24 Ltr/Day and Zinc Metal Silly @ 8.0 Kgs/Day.
3. The manufacturing process of the industry is Raw Material – Blank Cutting / Piercing on Press - Welding – Zinc Electroplating – Packing.
4. The industry has made agreement with M/S JBR Tech. Focal point, Ludhiana (CETP) for disposal of its trade effluent @ 4000 ltr/month.
5. The industry has installed water meter on pipeline leading to process area whose reading during visit was 16.83 KL.
6. The industry is maintaining record w.r.t. fresh water consumption for the wet process & effluent lifted to M/s JBR Tech. Pvt Ltd. The record is reproduced below:

Water consumed: 20.0 KL 16 KL 10000 ltr. 3550 ltr 4000 ltr. on 18.05.2024 15 days 4000 ltr.
As per the record the quantity of water consumed for wet process is in consonance with the quantity of effluent lifted to JBR Tech. Pvt. Ltd.
7. Domestic effluent generated by the industry is discharged into sewer.
8. The industry has installed 1 no. DG set of capacity 60 KVA, equipped with canopy and adequate stack height
9. The industry has submitted building plan prepared by Sh. Sukhjinder Singh approved Architect from Director of Factories, Punjab.
10. The site of industry is falls under the industrial focal point as per Master Plan, Ludhiana.
In the subject cited case, the industry has mentioned ground water extraction @ 1.7 KLD. Considering 25 working days per month, ground water extraction will be 42.5 KL/month, which is less than 300 KL/month.
It is therefore recommended that fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30.06.2027 with suitable conditions as per policy of the Board.
