It is submitted that was granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. RO/PTA/APC/2001/F-140 dated 11/06/2001 having validity upto 31/12/2015, for manufacturing of bricks @ 17,000 Nos/day with suitable conditions.
The industry has now applied for obtaining fresh consent to operate under the Water Act, 1974 and varied consent to operate under the Air Act, 1981. The industry has deposited online Rs. 24200/- (Rs. 17600/- and 600% penalty fee of Rs. 6600/-) vide Receipt No. 888628105 dated 21.05.2024 as consent fee on account of Water (Prevention and Control of Pollution) Act, 1974, which is adequate upto 30.09.2034 and Rs. 25800/- (Rs. 17600/- as air consent fee, 600% penalty fee of Rs. 6600/-, Rs. 1100/- as NOC regularization fee & Rs. 500/- as application form fee) vide online receipt no. 881926470 dated 21.05.2024, which is adequate upto 31.12.2028 as air consent fee against the investment of Rs. 8.97 lakh as on 31.03.2024 as per CA certificate dated 07.05.2024 submitted by it.
The industry has submitted a partnership deed on 01.04.2015 as per which Sh. Ajay Garg and Sh. Pawan Kumar, HUF are partners in the firm. The land is taken on lease by the BKO w.e.f. 01.12.2021 to 30.01.2027.
The industry has submitted completion certificate issued by CBRI, Roorkee w.r.t conversion of natural draft BKO of high draft with zig zag technology dated 20.02.2019.
On a general visit to the area by the Officer of this office on 12.06.2024, the BKO was visited and contacted Sh. Shelly, representative of the BKO at site. During visit, it was observed as under: -
1. The brick kiln was not in operation.
2. The kiln has stabilized the periphery road movement area with keri or bricks to minimize the fugitive dust emissions.
3. No unauthorized fuel was observed present at site of the kiln. Only coal and paddy straw pallets were lying at site.
4. Few plants were planted along the boundary wall of the BKO.
5. The Office toilets and labour toilets have been made and the representative informed that septic tanks have been provided for treatment of domestic effluent but the mode of treatment and disposal arrangements could not be verified as there was heavy bushes and grass in the area. The representative has been advised to clear the bushes and grass so that the treatment system and mode of disposal may be verified.
Keeping above in view, it is recommended that the application may be returned with the request to clear the bushes and grass so that the treatment system and mode of disposal may be verified and the report may be put up accordingly.
