File Note: It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTO/Renewal/LDH1/2024/25479707 dated 23/04/2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTO/Renewal/LDH1/2024/25473882 dated 23/04/2024 both valid upto 23/04/2025 for the manufacturing of Scaffolding fittings @ 5000 Nos./day. Earlier history Earlier, it was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH1/2023/23984126 dated 02/11/2023 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH1/2023/23984008 dated 02/11/2023 both valid upto 01/05/2024 with special conditions as under: 1. The industry shall complete the APCD to capture and treat fumes generated from pickling section, within three months. 2. The industry shall submit analysis report of APCD installed in the pickling section. The Competent Authority of the Board vide letter no. 6341-42 dated 02/11/2023 has decided to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 for restoration of electric connection available to the industry/premises temporarily upto 01.05.2024. To verify the compliance, the industry was visited by the undersigned on 16/04/2024 and observed as under: 1. The industry was in operation during the visit. 2. The industry is engaged in process of manufacturing of Forged Steel @ 5000 No.s/day using raw material as Sheet/Rod @ 5 MTD. 3. The industry has installed zinc plating section and HCL is also being used in the process. 4. The industry has provided alkali scrubber as APCD to capture and treat fumes generating from HCL. As per analysis report of sample collected during visit on 16.04.2024, acid mist (HCL) is reported as 3.6 mg/Nm3 against the prescribed standards of 35 mg/Nm3. 5. The industry has improved housekeeping in water polluting section. 6. The industry has provided water meter having reading 88.97 KL in the process area. 7. The industry has constructed new storage tank of size 12’x10’x10’ for storage of effluent to be generated from electroplating process as guided during earlier visits. 8. The industry has also provided electroplating section on its 3rd floor and has provided water meter on fresh water supply & reading of water meter was noted as 35.57 KL. 9. Lastly, the industry has got lifted its trade effluent @ 7500 ltr vide manifest no. 505992 dated 08.04.2024 to CETP. 10. The industry is maintaining record w.r.t. fresh water consumption for the wet process & effluent lifted to M/s JBR Tech. Pvt Ltd. The record is attached as PDF. As per the record the quantity of water consumed for wet process is in consonance with the quantity of effluent lifted to JBR Tech. Pvt. Ltd. 11. The industry has installed 1 no. shot blasting machine with bag filter house as APCD with stack of adequate height The industry was issued show cause notice for curtailment of validity of consent to operate under the Water Act 1974 and the Air Act, 1981 with opportunity of show cause in writing within 15 days. Further, auto renewed certificates generated by the industry were revoked by the Competent Authority of the Board and it was directed to apply for obtaining fresh 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Now, the subject cited industry has applied for obtaining fresh 'Consent to Operate' under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 141.17 Lacs as on 05/10/2023 CA Certificate dated 05/10/2023, which is adequate upto 30/06/2028 under Water Act, 1974 and Air Act, 1981, as per Board's Office Order dated 29/10/2018. It is pertinent to mentioned here that the industry was visited by this office on 20.10.2023 and 16.04.2024 and found complying. However, the industry is required to be visited 3 times for dropping direction of closure and permanent restoration of electric connection. Earlier, the electric connection of the subject cited industry was restored temporarily upto 01.05.2024. It is therefore recommended that 'Consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 may be renewed for six months with suitable conditions as per policy of the Board and PSPCL authorities may be directed to restore the electric connection for further 6 months.
