It is intimated that during routine visit to the area, it was observed that the subject cited industry had started operating its unit without obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Accordingly, the industry was issued show cause notice at Regional Office level, alongwith an opportunity of personal hearing on 03.05.2024, wherein, it was decided as under:
1. The project proponent shall apply for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, within 07 days.
2. The industry shall utilize its domestic effluent onto land for plantation within premises and shall not dispose of the same through any illegal mode of disposal.
3. The project proponent shall ensure compliance of provisions of environmental laws, at all times.
4. The representative of the project proponent was clearly informed that incase of non-compliance of the above decisions, action u/s 33-A of the Water (Prevention & Control of Pollution) 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981, shall be initiated against the project proponent without any opportunity of further personal hearing.
Now, the project proponent has applied for obtaining Fresh ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for production of Printed Aluminium Foil 45 @ MT/Year, alongwith an requisite documents.
The industry has deposited Rs. 28000/- vide R. no. 374432736 dated 10.05.2024 and Rs. 20000/- vide R. no. 258508736 dated 23.05.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 28000/- vide R. no. 798476108 dated 10.05.2024 and Rs. 20000/- vide R. no. 885846369 dated 23.05.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.09.2026 (Considering penalty and NOC regularization fee) for both the Acts against the fixed assets of Rs. 92.04 lakhs on 27.03.2024.
The industry has also submitted a copy of building plan signed by Er. Ashok Tayal, Competent Person, under the Factories Act, 1948.
The industry has submitted a copy of GST registration certificated dated 30.05.2022, as a proof of date of commissioning of the unit, alongwith the online application form.

Suitability of Site:
The industry is engaged in printing of pharmaceutical aluminium strip. The industry has submitted a copy of CLU issued to M/s Amogha Remedies by Department of Town and Country Planning, Punjab vide memo no. 306 dated 14.03.2019 for Khasra no. 16//9/2/2 total 02 kanal, 00 marla and land measuring 2.23 acres located at village Haibatpur, Derabassi, granted from Agricultural to Industrial (Pharmaceutical unit). Further, as per the said CLU, the site falls in F.E.Z Zone.
Thus, the site of the industry is suitable.
The unit has submitted a copy of the registry dated 01.11.2021 executed between M/s (First party) and Sh. Mukesh Jain (Second party).
Visit:
Accordingly, the site of the industry was visited by AEE of this office on 30.05.2024 and it was observed as under:
1. The industry is in operation and is engaged in printing of stickers used in pharmaceutical industries. The industry has now installed environmental data board at its entrance.
2. The industry has installed 03 no. printing machines in its premises.
3. The industry is not carrying out any wet process, platting, metal surface finishing or any trade effluent generating process in its premises.
4. The industry has installed one no. tubewell in its premises and flow meter is yet to be installed.
5. The industry has installed one no. DG set of capacity 100 KVA in its premises, which is equipped with canopy and stack of adequate height.
6. The industry has not installed any other source of air pollution such as boiler or furnace in its premises.
7. The industry is generating hazardous waste of category 33.1, 21.2 & 5.2. the industry has now provided a separate storage room for storage of hazardous wastes. The industry is required to obtain authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
8. The domestic effluent being generated from the premises is being sent to septic tank, after which in the same is used onto land for plantation.
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In the above, if may approved, the industry may be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 30/09/2026, subject to suitable conditions and additional conditions that:
1. The industry shall not carryout any activity in its premises which can change the category of unit from Orange to Red.
2. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within 07 days.
3. The industry shall not generate and discharge any kind of trade effluent from its premises.
4. The industry shall install flow meter on the tubewell installed in its premises, within 07 days.
5. The industry shall discharge only domestic effluent onto land for plantation within premises after passing through septic tank.
6. The industry shall not use any fuel in its premises, except HSD for operation of DG set.
7. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
8. The industry shall comply with the regulations of PWRDA, at all times.
9. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances.
10. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
11. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
12. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry.
13. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
14. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
15. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
