It is submitted that industry was issue show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.06.2024 in which following decisions were taken:- 1. The industry shall submit the technical data regarding per heat production and details of daily production since its commissioning, within 02 days. 2. The Environmental Engineer, Regional Office shall verify submission made by industry and submit recommendations, accordingly.
RO reported that the industry had submitted its reply on 07.06.2024 and the details are as under :- (A) PRODUCTION DETAILS:- (i) Period: 23.03.2024 to 05.06.2024 = 75 Days. (ii) Total Production during above said period = 3425.635 Tons. (iii) Average per day Production = 45.67 Ton. (iv) Average per year production with 365 days working = 16,671. 42 Ton. (B) SALE DETAILS:- (i) Period: 23.03.2024 to 05.06.2024 = 75 Days. (ii) Total Sale during above said period = 3385.860 Tons. (iii) Average Sale per day = 45.14 Ton. (iv) Average per year Sale with 365 days working = 16,477. 85 Ton. In Support to sale details industry had submitted GSTR-1 and GSTR-3B for the month of March and April, 2024 and Return for the Month of May, 2024 supposed to be submitted by 20th June, 2024 as informed by the Rep. of the industry. Note: The month wise information in tabular form is attached. The production figures are within the 30,000 TPA as stated above.
RO further submitted that application for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 is submitted for kind consideration of the Competent Authority of the Board, as industry has been established after obtaining Consent to establish (NOC) of the Board for installation of Induction Furnace of capacity 8 MT/Heat with the production of Steel Ingot @ 80 MT/Day (29,200 TPA).
It is further submitted that in case of M/s Aarti Steel International Limited, Village Harian, PO Uppal, Tehsil Koom Kalan, Machiwara Road, Ludhiana, the industry having induction furnace of 8 TPH capacity and consent to operate was granted by PBIP upto 30/09/2026 with conditions as imposed by RO and following additional conditions: 1. The industry shall not increase its production capacity beyond 30,000 MTA, under any circumstances. 2. The industry shall strictly not carry out any activity/ process in its premises, which is covered under the ambit of EIA notification dated 14/09/2006. 3. The industry shall submit details of daily production carried out in its unit and daily power consumption, on monthly basis, on 5th of every month, in Regional Office of PPCB. 4. The industry shall get the final completion certificate from PSCST and shall submit the same to the Board, within 03 months. 5. The industry shall keep its vehicular movement area and entry/exit points, stabilised at all times, as to suppress dust emissions. 6. The industry shall comply with the standard operating Procedure (SOP) laid down by the Board vide order dated 14.06.2018, for Air Pollution Control in Induction Furnace Units, and shall submit its compliance report on every 5th of every month in Regional Office, Fatehgarh sahib. In this case, it seems that production capacity might be more than 30,000 TPA which cover under EIA notification for Environmental Clearance.
If approved, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted /considered for short period of six months as per the above mentioned conditions and with special conditions that if production increases beyond 30,000 TPA, the consent to operate will be revoked automatically and the industry will obtain Environmental Clearance before further renewal of the consent, please.
