Subject: - Proceedings of the personal hearing given to M/s Guru Kirpa Industry, Saide Wala Road, Boha, Tehsil Budhlada, District Mansa before refusal of consents to operate under the provisions of Water Act, 1974 and Air Act, 1981 by the Senior Environmental Engineer on 13.06.2024.

It was brought out that the industry was granted 'consent to establish' (NOC) under Water Act, 1974 & Air Act, 1981 dated 27.12.2022 (valid upto 26.12.2023) for production of card Board/Mix Board @ 8 TPD by using Primary ETP sludge of pulp paper mill @ 5 TPD, Paddy Straw @ 3.25 TPD & Jute Bags/Gunny Bags @ 3.25 TPD as raw material.
Now the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 & Air Act, 1981 for production of card Board/Mix Board @ 8 TPD.
The industry was visited by officer of the Board on 28.05.2024 and it was observed that:-
1. The industry was in operation during visit and also found utilizing ETP sludge of pulp & paper mill without obtaining authorization/passbook as required under the HOWM Rules, 2016.
2. No flow meter installed on the line provided for reutilization of the effluent back into process.
3. The industry has not developed adequate plantation along the boundary wall.
The industry is not complying with the conditions of 'consent to establish' (NOC) granted under the provisions of Water Act, 1974 & Air Act, 1981 and also failed to comply with guidelines of SOPs framed for such type units.
In view of above, show cause notice refusal of consents to operate under the provisions of Water Act, 1974 and Air Act, 1981 issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 13.06.2024.
During hearing, the representative of the industry attended the hearing and submitted written reply w.r.t. notice issued to it, which has been taken on record. He further stated that they have started on trial basis for testing the machinery and not in operation now.
After hearing, the representative of the industry as well as the officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that Environmental Engineer, Regional Office, Bathinda shall visit the site of industry and verify the submission made by the representative of the industry, within 7 days and process the applications on merits.
