It is submitted that the industry was granted Consent to Establish/NOC vide no. CTE/Fresh/BTI/2023/22133877 dated 27.05.2023, which was valid upto 26.05.2024 for establishment of rice sheller unit of capacity 3TPH of Raw rice/Sorted Rice with dryer, subject to the conditions mentioned therein.
The rice sheller was visited by the AEE of this office on 27.03.2024 and it was observed that: -
• The rice sheller was in operation during visit. The industry has installed the machinery for the production of sorted Raw Rice with dryer.
• The rice sheller has installed shelling section which was equipped with cyclone as APCD, however, no stack above roof level has been provided with it.
• The rice sheller has installed dryer section and Cyclone with stack height has been provided with it.
• The rice sheller has provided brick paved road on the movement area.
• The rice sheller has not provided plantation along the boundary wall.
• The rice sheller has provided septic tank for the treatment of domestic effluent. The representative of the industry informed that same is being lifted through mobile tanker.
• The Rice sheller has stored the rice husk inside the premises a wall and wind screen of adequate height and length in front of rice husk discharge area has been provided.
Accordingly show cause notice without hearing was issue to the industry vide this office letter no. 1512 dated 04.04.2024. Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 & the Air Act, 1981.
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 & the Air Act, 1981 through OCMMS for operation of rice sheller unit of capacity 3 TPH of Raw rice /Sorted Rice with Dryer under the Orange category as per the prevailing policy.
The industry has submitted Acceptance / approval of Proposed building plans from Joint Director of Factories for Director of Factories, Punjab vide no. 481 dated 28.03.2024, undertaking regarding completion of APCD’s installed and compliance of NOC conditions.
The industry has also submitted the CA certificate dated 22.04.2024, wherein, the value of total fixed assets of the unit as on 20.04.2024 is Rs. 198.81 lakhs with value of plant & machinery is Rs. 86.68 lakhs. Accordingly, the industry has deposited consent fee of Rs. 50400/- vide R No.
P135240322557909 dated 14.05.2024 under the Water Act, 1974 & Rs. 50400/- vide R No. P135240322561409 dated 14.05.2024 under the Air Act, 1981. As such, as per circular dated 29.10.2018, the fee deposited by the industry under both the Acts is adequate upto 30.09.2028.
Sh. Amrinder Singh, Partner of the industry has submitted the reply of show cause notice w.r.t. the clarification raised stating that they have provided the stack with roof level, sufficient plantation has been done and septic tank has been provided.
Further, the industry was visited by undersigned on 13.06.2024 During visit, it was observed as under:
• The rice sheller was not in operation during visit. The industry has installed the machinery for the production of sorted Raw Rice with dryer.
• The rice sheller has installed shelling section which was equipped with cyclone as APCD alongwith adequate stack height.
• The rice sheller has installed dryer section and Cyclone has been installed with it alongwith adequate stack height.
• The rice sheller has provided brick paved road on the movement area.
• The rice sheller has now provided fresh plantation along the boundary wall.
• The rice sheller has provided septic tank for the treatment of domestic effluent alongwith provision to discharge to planation.
• The Rice sheller has stored the rice husk inside the premises a wall and wind screen of adequate height and length in front of rice husk discharge area has been provided.
From above, it is clear that the unit is complying with the code of practice stipulated for such units and provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981.
In view of above, it is recommended that fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for operation of rice sheller unit of capacity 3 TPH of Raw rice/Sorted Rice with Dryer may be granted to the unit upto 30.09.2028 with suitable conditions along with special conditions that:
1. The industry will get its stack emissions samples analyzed from Board's lab within 6 months, positively.
2. The industry will discharge only treated domestic effluent onto land for plantation / green belt.
3. The industry shall not increase its existing land area without prior permission of the Board.
4. The industry shall not increase its production capacity without the prior written permission/NOC of the Board.
5. The industry shall comply with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide order dated 15.10.2013 as follows:
i) All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories.
ii) The industry should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the rice sheller/ Saila plant.
iii) All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 meters above roof of the building.
iv) The management and handling of rice husk in the rice shelling units/ Saila plants should be done as under:
(a) All the rice shelling units/ Saila plants shall provide paved/brick roads/cement concrete roads / metalled roads inside their premises for movement of vehicles, so as to prevent the generation of dust.
(b) (i) The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10' high or 3.5' higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35' on each side of the rice husk discharge pipe.
(ii) The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5' height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of airborne particulate from storage, handling and loading/unloading areas of rice husk.
(iii) The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15'', which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3'length.
(iv) Wherever, height of rice husk is 3' or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70 gm/m2 weight having 40-45 hole/inch2 to prevent wind blowing of stored husk.
(c) During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds.
