It is intimated that the project is a small-scale orange category commercial project. Earlier, the project proponent was granted Consent to Establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2023/23277262 dated 09.09.2023 having validity upto 30.06.2024 for 41 showrooms (LG/UG/1st and 2nd floor) with discharge of Domestic Effluent @ 42 KLD - After STP, reuse for flushing purpose and remaining discharged into sewer with subject to certain conditions and special condition as mentioned therein.
Now, the project proponent has applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for 41 showrooms (LG/UG/1st and 2nd floor) alongwith requisite documents and fee.
The project proponent has deposited Rs. 90,000/- vide R. No. 48877112 dated 11.06.2024 under Water Act, 1974 and Rs. 90,500/- vide R. No.
559505756 dated 11.06.2024 under Air Act, 1981 including application form fee, against the total cost of fixed assets is Rs. 853.5 lacs as on 30.05.2024. The consent fee deposited by the project proponent is adequate upto 30.06.2029 under both acts.
The project proponent has submitted copy of partnership deed made on 09.07.2020 between Sh. Avinash Kumar and Sh. Neeraj Gupta.
The project proponent has submitted approved site plan from ADC (UD) vide no. LDC/CA-ADC(UD)/2022/2531 dated 23.06.2022.
The project proponent has submitted copy of letter vide no. 566 dated 26.05.2022 issued by MC, Zirakpur, wherein, it has been mentioned as under:
“ਤਸਦੀਕ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਜੀ ਐਨ ਜੀ ਹਾਈ ਸਟਰੀਟ, ਕਿਸ਼ਨਪੁਰਾ ਰੋਡ, ਢਕੋਲੀ, ਜ਼ੀਰਕਪੁਰ ਦੇ ਕਮਰਸੀਅਲ ਪ੍ਰੋਜੈਕਟ ਏਰੀਏ ਦੇ ਨਾਲ ਲਗਦੇ ਏਰੀਏ ਵਿੱਚ ਨਗਰ ਕੌਂਸਲ, ਜੀਰਕਪੁਰ ਵੱਲੋ ਸੀਵਰੇਜ ਦੀ ਸੁਵਿਧਾ ਉਪਲੱਬਧ ਹੈ। ਸਰਕਾਰ ਵੱਲੋ ਨਿਰਧਾਰਤ ਸਾਰੇ ਚਾਰਜਿਜ ਨਗਰ ਕੌਂਸਲ, ਜੀਰਕਪੁਰ ਵਿਖੇ ਜਮ੍ਹਾਂ ਕਰਵਾਉਣ ਉਪਰੰਤ ਅਤੇ ਰੂਲਾਂ ਅਨੁਸਾਰ ਸੀਵਰੇਜ ਵਾਟਰ ਨਗਰ ਕੌਂਸਲ, ਜੀਰਕੁਪਰ ਵਿਖੇ ਬਨਦੇ ਚਾਰਜੀਜ ਭਰਵਾਉਣ ਉਪਰੰਤ ਨਗਰ ਕੌਂਸਲ ਦੇ ਮੇਨ ਸੀਵਰ ਨਾਲ ਜੋੜਿਆ ਜਾ ਸਕਦਾ ਹੈ।”
As such, the PP has obtained permission from MC Zirakpur for discharge of treated sewage vide no. 566 dated 26.05.2022, which is well before the directions issued to MC Zirakpur by the Board on 15.06.2022. Also decided in the review meeting of this office on 13.7.2023, the permissions may be given to such projects, which are having permission from MC regarding connectivity of MC sewer before 15.06.2022. The pp has already been granted NOC/CTE for discharge into MC sewer.
The site of the project was visited by officer of this office on 15.06.2024 and it was observed as under: -
1. The site falls in the revenue estate of Village Dhakoli, Zirakpur, Derabassi, SAS Nagar.
2. All the 41 plots have been constructed having configuration (LG/UG/1st and 2nd floor). However, the possession is yet not started.
3. The project proponent has installed STP of capacity 75 KLD based on MBBR technology followed by UF membrane for their commercial project and also submitted completion certificate for the same.
4. The project proponent has also provided water meter and energy meter and maintained record regarding the same.
5. The total water generation of the project is 49 KLD which is treated in the STP.
6. The treated water @ 38 KLD - After STP, shall be reuse for flushing purpose and remaining 11 KLD will be discharged into sewer.
7. The project proponent has installed one. D.G set of capacity 125 KVA, which is equipped with canopy and adequate stack height.
8. The project proponent has submitted permission from PWRDA vide no. PWRDA/11/2022/L1/478 dated 14.11.2022 for abstraction of ground water.
9. The project proponent has provided purchase order of mechanical composter and the same shall be installed within one month.
In view of the above, it is recommended that the consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.06.2029 with subject to the suitable conditions and additional conditions that: -
1. The project proponent shall install mechanical composter within one month.
2. The project proponent shall operate its STP regularly & efficiently and shall maintain operational record of the same on daily basis.
3. The project proponent shall submit effluent analysis results from Boards lab within one month.
4. The project proponent will not discharge its untreated/treated wastewater into any drain/choe/river under any circumstances.
5. The project proponent shall maintain separate record regarding treated water being generated from the project and being re-utilized in green area and flushing.
6. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be collected.
7. The project proponent shall not discharge any treated/ untreated wastewater into sewer/ drain/ choe under any circumstances.
8. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
9. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
10. The project proponent shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
11. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
13. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and / or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time, at all times.
