It is submitted that the industry is a Small Scale, Orange Category unit. Earlier, the industry was issued notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 06.06.2024.
Sh. Charanjeet Kumar, proprietor of the industry attended the hearing and submitted that the industry is engaged in the process of powder coating. They have increased stacks of powder recovery unit, baking oven and D.G. set. They have closed the soakage pit and constructed the septic tank. They have applied for consents of the Board.
After hearing the industry, officer of the Board and considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided as under:-
1. The industry shall discharge only domestic effluent onto land for plantation through septic tank.
2. The industry shall remove stagnation from plantation area and shall ensure that there is no stagnation in future.
3. Environmental Engineer, Regional Office shall verify submissions made by the industry and process consent applications on merits.
Now, the industry has applied fresh consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite document and fee. The site of the industry was visited by the AEE and JEE of this office on 07.06.2024 and it was observed as under:-
(A) COMPLIANCE OF THE DECISIONS OF PERSONAL HEARING:-
1. Now, the industry is discharging only domestic effluent onto land for plantation through septic tank.
2. No stagnation observed inside or outside the factory premises
(B) OTHER DETAILS OF VISIT ARE AS UNDER:-
1. The industry was in operation during visit.
2. The industry is engaged in the process of manufacturing Mudguard, Mudguard wire with powder coating process.
3. The manufacturing process involves: Rolling Cutting Bending Powder Coated BakingPackaging Despatch.
4. It has installed 25 No. powder presses of different capacities,
5. It has installed 2 powder coating booth with powder recovery unit as APCD. Now, it has provided adequate stack height to its powder recovery units.
6. It has installed 1 electric baking oven and 1 diesel fired baking oven. Now, it has provided adequate stack height to its diesel fired baking oven.
7. It has installed a D.G.Set of 40 KVA with canopy. Now, it has provided adequate stack height to its D.G.Set.
8. It has provided septic tank to treat the domestic effluent and treated domestic effluent is discharged onto land for plantation.
9. It has plugged the soakage pit permanently.
10. The industry has submitted the letter issued by DTP, Ludhiana vide no.1092 DTP certificate 07.5.2024 vide which the site of the industry falls in industrial zone as per Master Plan, Ludhiana (2007-31).
11. As per CA certificate submitted by the industry the value of total fixed assets is Rs. 91.87 Lacs as on 21.03.2024.
12. As per consent applicable form the Date of Commissioning of the industry is Nov / 2021, but it has purchased the used powder coating booth with gun and oven in August, 2022.
13. The industry has deposited fee Rs. 44800/- R.No. 23110766 dated 05.06.2024 as under:-
August, 2022 to July, 2027 = 5 Years * Rs.5600/- = Rs. 28,000/-
Late Fee: August, 2022 to June,2024 = 2 Years * Rs. 5600/- = Rs. 11,200/-
NOC Regularisation Fee = Rs. 5,600/-

Total = Rs. 44,800/-
14. It has also deposited Rs. 500/- as consent form fee vide R.No. 743184988 dated 11.06.2024.
15. The consent fee deposited by the industry is adequate upto 31.07.2027.
Keeping in view of the above, it is recommended that consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 Granted upto 30.06.2027 with usual conditions and with the special condition that the industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 within 07 days.
