File Note: It is submitted that the industry is a small-scale green category unit. Earlier, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. Zonal/Mohali/WPC/2006/F-239 dated 19.06.2006, valid upto 18.08.2006 for manufacturing of Mix Board @ 2 T/day with subject to suitable conditions mentioned therein. Thereafter, the industry was visited by the officer of the Board on 14.03.2023 and it was observed as under: - 1) The industry was in operation at the time of visit. 2) The industry is involved in manufacturing of Mill Board (Gatta) using kraft paper pulp & bleached paper pulp from M/s Shreyans Paper Mills, Balachaur and M/s Ruchira Paper, Kala Amb, HP and cardboard dust. 3) The manufacturing process is as under: Raw Material Beating---- Mixing of Paper Pulp, cardboard dust—Moulding & Pressing---- Drying in Sunlight---- Finishing---- Cutting and Lamination. 4) The industry has installed 1 no. submersible pump which is not provided with water meter. 5) No waste water is disposed from the process as entire water is being recycled. 6) The industry has provided septic tank for treatment of domestic waste water generated from 8 labour quarters. 7) The industry has not installed any DG set. 8) The industry has not provided Environmental Data Board outside the premises. 9) As per masterplan, the site is located in existing built up area and at a distance of 100 mtr from the boundary of Sushma Valencia residential project. 10) The industry is operating since 10-15 years. 11) The industry is not complying with the following SOP of Storage & Handling of Process and primary sludge of ETP of Pulp & Paper industry: a. The industry has not stored the primary ETP Sludge & Process Sludge in covered storage shed(s) within premises, so as to eliminate rain water intrusion. b. Transportation of primary ETP Sludge & Process Sludge is not being done after obtaining authorisation from the concerned SPCB under the Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016. c. The entire process area is not having boundary wall or fencing with proper slope, periphery drainage and collection pit followed by channelization to Effluent Treatment Plant for treatment. d. All personnel involved in the plant operation were not wearing proper personal protective equipment such as masks, safety gloves, goggles, safety shoes etc. e. The unit is not submitting quarterly and annual information on quantity of ETP Sludge & Process sludge procured & utilized and its source, quantity of waste water generated, treated & recycled or resources conserved (specifying the details like type and quantity of resources conserved) to the concerned SPCB. f. The unit is not maintaining a passbook issued by concerned SPCB wherein the following details of each procurement of Process sludge & Primary Sludge (of pulp & paper industry) has to be entered g. A log book with information on source of procurement, quantity, date wise utilization of the same, quantity of products manufactured, hazardous waste generation and its SoPs for utilization of Hazardous Waste is not being maintained. Accordingly, the industry was given personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on dated 18.04.2023 and it was decided as under: - 1. The industry shall not use kraft paper pulp as raw material for the manufacturing of paper Board (gatta) without prior permission of the Board as well as obtain authorization as required u/s 9 of the Hazardous of other Waste (Management & Transboundry Movement) Rules, 2016. If fails, then notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to the industry. 2. The industry shall not store the kraft paper pulp/primary ETP sludge in its industrial premises. 3. The industry shall immediately apply for consent to operate as required under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 of the Board. 4. The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry, verify the statements of the industry, process the applications of the industry on merits and send his report/recommendations. 5. In case any violation is observed, action u/s 33-A of the Air (Prevention & Control of Pollution) Act, 1981 will be taken against the industry. Thereafter, the industry was issued show cause notice vide no. 7455 dated 27.09.2023 for non-compliance of the decisions of the hearing given by the Senior Environmental Engineer (ZP-1) of the Board on 18/04/2023 with an opportunity to submit the reply within 15-days. Accordingly, the industry was given reply of show cause notice and as per which: - 1. Regarding paper pulp lying in the premises, we have already stopped using paper pulp and the pulp lying in our premises during the visit of the Board’s officer on 09/06/2023 was immediately got lifted by the supplier. 2. Water meter has already been provided on submersible pump. 3. The environmental data board has already been provided outside the premises. 4. As we have stopped using paper pulp, we have got the category changed from the computer section of the Board and now applied for grant the varied consent to operate under Green Category. Now, the industry has applied for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Mill Board @ 2 MTD by using Waste Paper/Parali @ 2 MTD as raw material alongwith requisite documents and fee. The industry has deposited Rs. 9,000/- vide UTR. No. BARBQ24100587700 dated 09.04.20024 under the Water Act, 1974 and Rs. 9,000/- vide UTR. No. BARBQ24100593318 dated 09.04.2024 under Air Act, 1981, against the total cost of fixed assets is Rs. 4.90 lacs as on 28.08.2023. The consent fee deposited by the industry is adequate upto 31.12.2027 under both acts including NOC fee and Penalty/late fee. The industry has submitted land classification certificate issued by DTP SAS Nagar vide no. 1165 dated 21.07.2023, as per which the site falls in Mixed Land Use and Residential Zone as per Master Plan Zirakpur. The industry was visited by the officer of the Board on 15.06.2024 and it was observed as under: 1) The industry was in operation during the visit and engaged in manufacturing of mix board. 2) The industry is using waste paper and parali as raw material and has stopped using sludge from the paper industries. 3) The manufacturing process of the industry is as under: - Waste Paper/Parali as raw material—Mixing (Waste Paper/Parali & Water)—Moulding—Sun Drying—Press & Cutting—Mix Board. 4) The manufacturing process of the industry is covered under green category i.e. 3009- Cardboard or Corrugated Box and paper product (excluding paper or pulp manufacturing) with gas/ electric operated oven/ boiler only. 5) No trade effluent is generated by the industry and the entire effluent is recirculated. 6) Only domestic effluent, which is being discharged into onto land for plantation after septic tank. 7) The industry has not installed any D.G set, also there is no other source of air pollution. The industry is now complying with the observations of the earlier visit. It is pertinent to mention here that the site is located within the MC limits of Zirakpur and is surrounded by residential projects. The industry has submitted land classification certificate issued by DTP SAS Nagar vide no. 1165 dated 21.07.2023, as per which the site falls in Mixed Land Use and Residential Zone as per Master Plan Zirakpur. The master plan of Zirakpur was notified vide notification no. 8350-CTP(Pb)/SZ-6 dated 13.11.2009. As such, the industry estabalished in non-conforming zone before the date of notification of master plan can continue for 15 years i.e. upto 12.11.2024 only. In view of the above, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 12.11.2024 with subject to suitable conditions and additional conditions that: - 1) This consent is only valid for manufacturing of Mill Board @ 2 MTD by using Waste Paper/Parali @ 2 MTD as raw material. 2) The industry shall obtain permission u/s 79 of the Punjab Regional and Town Planning and Development Act, 1995, from GAMDA to the effect as to how much time the industry can continue its operation at this site and submit the same to the Board. 3) The industry will be bound to comply with the zoning regulation of the master plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t. other stipulations by any authority or the zoning regulations of the master plan. 4) The industry shall not generate and discharge any kind of trade effluent from its premises. 5) The industry shall not carry out any activity in its premise, which can change the category of unit from Green to Orange/Red, without prior permission from PPCB. 6) The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 7) The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received. 8) The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 9) In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions.
