File Note: Subject: - Proceedings of the personal hearing given to M/s Divya Real Estates, Moga Road, Village Gill, Tehsil Baghapurana, Distt. Moga before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 by the Senior Environmental Engineer on 13.06.2024. Balkrishan Garg, Partner It was brought out that the project proponent has applied for obtaining 'Consent to Establish' (NOC) under the Water Act, 1974 & Air Act, 1981 for establishment of residential colony in an area of 44 kanals 17 marlas (27,134 square yards) for development of 88 no. residential plots & 10 no. commercial shops. From the perusal of the documents submitted by the project proponent, it has been observed that:- 1. Copy of CLU obtained from the Competent Authority for development of the colony not submitted. 2. Copy of license obtained from the Competent Authority not submitted. 3. The project proponent has proposed discharge of treated effluent onto land for plantation, however proper layout plan alongwith khasra nos. of the said plantation area not submitted. 4. ETP proposed of capacity 60 KLD, considering 5 persons/plot, however as per the Department of Housing and Urban Development notification issued vide no. G.S.R. 144/P.A.11/1995/Ss.180 and 43/2021 dated 31.08.2021 circulated by the Board vide Head Office letter no. 15864-82 dated 22.07.2022, it has been specified that the population of plotted development shall be counted @ 15 persons per plot, hence the calculation of water pollution load as well as the disposal arrangements proposed by the project proponent are not adequate. The project proponent has been issued show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer on 27.03.2024. During hearing, Sh. Vinod Goyal, Consultant attended the hearing and requested for some time to provide adequate calculation of water pollution load as well disposal arrangement and also to submit the copy of license issued by the Competent Authority for development of the residential colony. After hearing, it was decided by the Senior Environmental Engineer (B) that:- 1. The project proponent will submit all the requisite documents alongwith proper calculation of water pollution load as well as disposal arrangements to the Regional Office, Faridkot of the Board, within 03 days. 2. Environmental Engineer, Regional Office, Faridkot shall verify the documents submitted by the project proponent and process the application applied for obtaining 'consent to establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981, on merits. Thereafter, the project proponent has failed to submit any compliance w.r.t. the decisions of the personal hearing dated 27.03.2024 and consent to establish (NOC) applied by the project proponent under the Water Act, 1974 & Air Act, 1981 is refused. Now, the project proponent has applied for obtaining 'Consent to Establish' (NOC) under the Water Act, 1974 & Air Act, 1981. From the perusal of the documents submitted by the project proponent, it has been observed that the project proponent has proposed total average daily water consumption @ 206 KLD. Total wastewater generation proposed @ 165 KLD, out of which 25 KLD will be utilized on an area of approx. 01 acre to be developed under parks / green belt to be developed along the roads; 35 KLD to be discharged onto land to be developed under plantation in an area of 05 kanals 16 marlas adjoining to the premises of the colony (this land area belongs in the name of the colony) and 100 KLD (approx. 50% of the total fresh water requirement) has been proposed to be reutilized for flushing purposes by providing dual plumbing line. The proposal submitted by the project proponent for discharge / reutilization of the treated wastewater does not seems to be adequate / feasible. In view of above, show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 has been issued to the project proponent alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 13.06.2024. During hearing, the partner of the project attended the hearing and stated that they have arranged additional land and they will apply fresh application with the amended proposal. After hearing, the partner of the industry as well as the officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that:- 1. 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 applied by the project proponent be refused. 2. The project proponent will submit fresh application for obtaining 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 with amended proposal. Submitted for confirmation of the decisions of the proceeding of hearing dated 13.06.2024, please.
