File Note: The hot mix plant was granted consent to establish (NOC) under the water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/FDK/2023/23117705 dated 21.08.2023 valid upto 20.08.2024 for operation of hot mix plant in land area of 07 Kanals 11 marlas bearing khasra nos. 256 min (8-0) falling in the revenue estate of Village Chak Bodla, district Faridkot, subject to the suitable conditions therein. Further, the industry has failed to obtain Consents to operate of the Board. The HMP was visited by officer of this office on 04.04.2024 and it was observed that: 1. The hot mix plant was not in operation. However, as per site conditions, it seems that the same was being operated by the project proponent. 2. The HMP has provided dust collection mechanism followed by wet scrubber as APCD with the rotary furnace. The industry has provided recirculation system for scrubber water. The APCD of hot mix plant was in operationable condition. 3. The HMP has provided adequate stack height attached with bitumen tanks. 4. The HMP has not stabilized its vehicle movement area. 5. The HMP has two no. of bitumen heaters equipped with adequate stack heights. 6. The HMP has provided septic tank for treatment of domestic effluent and discharged onto land for irrigation / plantation. 7. The industry has not planted trees along the boundary. 8. The industry has not applied for consent to operate under Water Act, 1974 and Air Act, 1981 and is operating its plant without obtaining consent to operate of the Board. The industry was not complying with the code of practice as well as conditions of Consent to establish (NOC) granted to it under Water Act, 1974 and Air Act, 1981 The industry was issued notice vide no. 1626 dated 09.04.2024 to apply for consent to operate under Water Act, 1974 and Air Act, 1981. The industry has neither applied for consent to operate nor submitted any reply in this regard. The industry was afforded opportunity of personal hearing on 23.05.2024, which was attended by Sh. Harmesh Sharma, Partner Sh. Vikas Sharma, Partner of the industry. During hearing, the Partners of the industry submitted that the hot mix plant was operated on trial basis and has not been operated for commercial production. They further stated that all the shortcomings have been attended and applications applied for obtaining CTOs under the Water Act, 1974 & Air Act, 1981. After hearing the Partners of the industry as well as officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that the Environmental Engineer, Regional Office, Faridkot shall visit the site of hot mix plant, verify the submission made by the Partners of hot mix plant and process the consent applications to be applied by it under Water Act, 1974 & Air Act, 1981, on merits. The hot mix plant has applied for fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 and the details of the case are as under:- The industry has deposited Rs. 14,500/- vide UTR/Ref. No. IOBAN24144616676 dated 23.05.2024 under the Water Act, 1974 and Rs. 14,500/- vide UTR/Ref. No. IOBAN24144616750 dated 23.05.2024 under Air Act, 1981, against the fixed assets of Rs. 45.91 Lakhs as on 21.05.2024 as per CA certificate. Thus, the consent fee is adequate upto 30.09.2028 under each Acts. The industry has submitted completion certificate of air pollution control device as proposed during the NOC application. To check the compliance, the hot mix plant was visited by undersigned (AEE) on 18.06.2024 and it was observed as under:- 1. The hot mix plant was not in operation during visit. 2. The hot mix plant has installed dust collector followed by wet scrubber as APCD to contain the emissions from asphalt drum with adequate stack height and sample collection facilities. The industry has provided re-circulation system for re-circulate the scrub water. The energy meter has been provided with recirculation system. APCD and recirculation system was found inline / in working condition. 3. The hot mix plant has provided adequate stack heights with 02 no. bitumen heater installed in the premises. 4. The hot mix plant has stabilized its movement area by laying stone aggregates and has arrangement of mobile tanker for sprinkling of water to suppress the dust emissions generates during the movement of vehicles. 5. The hot mix plant has installed DG set of capacity 125 KVA with canopy of adequate stack height. 6. The hot mix plant has provided septic tank for treatment of domestic effluent with outlet to discharge onto land for plantation developed along the boundary wall. 7. The hot mix plant has planted fresh sapling of trees along its boundary. The hot mix plant is now complying with the provisions of the Water Act, 1974 and the Air Act, 1981 Keeping in the view of above, It is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the hot mix plant for a period upto 30.09.2028, subject to the suitable conditions alongwith the followings:- 1) The hot mix plant shall submit its operational schedule so as to carry out air emission sampling, within one month. 2) The hot mix plant shall always comply with the code of practice prescribed for such type of units.
